Notwithstanding any other provision of law to the contrary, the supremePage court1 may elect to apply the provisions of R.S.3 Coding:

456 ENROLLED supreme court may elect to apply the provisions of R.S.

11:1351 through 1358, the supremecourtsupreme court mayassign a retired judgetoacourtonacontractualorperdiembasis.Insuchcase,andnotwithstanding anyprovision ofR.S.11:1381or443orany otherprovision of law tothecontrary, the assigned retired judge shall be entitled to compensation, in addition to his retirementpay, in an amount equal to one-twentieth of themonthlysalaryofathe judgemonthlysalaryofajudge of the court to which he is assigned for each dayof service under such assignment, but not to exceed one hundred twenty working or judicial days in a fiscal year.

(2)The supremecourtmaysetthesupremecourtmaysetthecompensation compensation payable toan assigned Pageretired 2judge at an amount lower than the amount specified in Paragraph (1) of 4this Coding:Subsection.

This Act shall become effective upon signature bythe governor or, if not signedbythegovernor,uponexpirationofthetimeforbillstobecomelawwithoutsignature byPage the2 governor, as provided in Article III, Section 18 of the3 ConstitutionCoding: of Louisiana.

If vetoed bythe governor and subsequentlyapproved bythe legislature, the Act shall become effective on the dayfollowing such approval.

1:13(B) and 24:177(E)] DIGEST SB 456 Engrossed 2026 Regular Session Talbot Presentlawprovides specificprovisions requiringjudgesandcourtofficerswhotakeoffice on or after July1, 1983, to become members of the Louisiana State Employees' Retirement System (LASERS) by granting the ability to obtain and transfer credits within the system.

Judges and court officers who held office prior to July 1, 1983, continue to be governed by the retirement laws applicable at the time of their initial service.

Present law further specifies that these specific provisions are inapplicable to those whose first eligibility for membership in any state retirement system occurred on or after January 1, 2011.

While these individuals remain members of LASERS, they are subject to the standard provisions applicable to regular system members.

Proposed law provides that present law restrictions regarding membership occurring on or after January 1, 2011, do not apply to retired judges serving on assignments.

Proposed law provides for the definition of "membership in one of the state systems" and authorizes an irrevocable election to be made within 30 days of employment.

Present law allows a retired judge to be assigned to a court of record while continuing to receive his retirement pay, although that amount is deducted from his salaryas an assigned judge.Proposedlawauthorizesthesupremecourttodeterminetheapplicablecompensation provisions to apply to a retired judge assigned under statute or the court's inherent Page 3 of 4 Coding:
