Page 6 of 12 SB002020.100 - 876 - XXXX 3/31/2026 3:54 PM Engrossed UNOFFICIAL COPY 26 RS SB 20/EN (4) This requirement shall not apply in an emergency if the chief executive officer of the city, county, or district has duly certified that an emergency exists, and has filed a copy of the certificate with the chief financial officer of the city, county, or district, or if the sheriff or the county clerk has certified that an emergency exists, and has filed a copy of the certificate with the clerk of the court where his necessary office expenses are fixed pursuant to KRS 64.345 or 64.530, or if the superintendent of the board of education has duly certified that an emergency exists, and has filed a copy of the certificate with the chief state school officer.

Upon creation of a fire protection district or a volunteer fire department district as provided in KRS 75.010, the affairs of the district shall be conducted by the board of trustees consisting of seven (7) members, four (4) to be elected by the members of the district as hereinafter set out and Legislative Research Commission PDF Version ACTS OF THE GENERAL ASSEMBLY three (3) to be appointed by the county judge/executive or the mayor in a consolidated local government pursuant to the provisions of KRS 67C.139.

The trustee to be removed shall be notified of his or her proposed removal and the reasons for the proposed removal by registered mail sent to Page 9 of 12 SB002020.100 - 876 - XXXX 3/31/2026 3:54 PM Engrossed UNOFFICIAL COPY 26 RS SB 20/EN his or her last known address at least ten (10) days prior to the hearing.

(e) The removal of an elected firefighter trustee of a fire protection district shall be subject to the approval of the fiscal court of the county in which the greater part of the district is located in those counties not CHAPTER 90 5 containing a consolidated local government or the legislative council in a county containing a consolidated local government.

(1) A vacancy shall be declared to exist in the office of any board of trustees member serving under Section 5 of this Act who does not qualify under subsection (1)(a)2.

and (2) A vacancy shall be declared to exist in the office of any board of director member serving under Section 6 of this Act who does not personally reside in the geographic area served by the corporation, and the vacancy shall be filled in accordance with KRS 273.213.
