NEW SECTION.
Section 716.7, subsection 1, Code 2026, is amended by adding the following new paragraphs:
648.24 Unlawful squatting.
NEW PARAGRAPH .

As used in this section:

NEW PARAGRAPH.
“Premises” means a dwelling, commercial building, or vacant or unimproved real property.

c.
“Lawful authority” means the ability of a person to produce a deed or mortgage statement in the person’s name, a lease agreement that includes the name and signature of the property owner or an authorized representative of the property owner, a valid written or electronic agreement or communication authorizing the person to enter upon the property, or a receipt or other reliable evidence of a rent payment made to the property owner or an authorized representative of the property owner dated within the last sixty days.
(1) “Unlawful squatting” means entering and residing unlawfully in a premises when the person entering and residing in the premises is not privileged or licensed to do so.
NEW PARAGRAPH .
(2) “Unlawful squatting” includes without limitation taking up residence in a premises a person does not own if all of the following are true:
g.
(a) The person is not a current tenant at the premises.
“Squatting” means a person knowingly taking up residence at a property not open to the public without lawful authority.
(b) The person does not have a valid agreement to occupy the premises.
Sec.
(c) The person is not an immediate family member of the owner of the premises.
A person commits the offense of unlawful squatting if all of the following circumstances apply:
Section 716.7, subsection 2, paragraph a, Code 2026, is amended by adding the following new subparagraph:
a.
NEW SUBPARAGRAPH .
The person:
(2A) Squatting, if all of the following are true:
(1) Knowingly enters the premises of another person.
(a) The person is not a current tenant at the property.
(2) Knowingly resides on the premises of the other person for any period of time.
(b) The person does not have a valid agreement to occupy the property.
(3) Knowingly acts without lawful authority in entering and residing on the premises.
(c) The person is not an immediate family member of the owner of the property.
(4) Cannot produce at least one of the following documents:
(d) The person acts without lawful authority in entering and residing on the property.
(a) A deed or mortgage statement in the person’s name for the premises.
Sec.
(b) A lease agreement that includes the name and signature of the other person or an authorized representative of the other person.
(c) A valid written or electronic agreement or communication authorizing the person to enter upon the premises.

2629 (d) A receipt or other reliable evidence of a rent payment made to the other person or an authorized representative of the other person dated within the last sixty days.
b.
The premises the person enters upon is not open to the public at the time of entry.
c.
The owner of the premises has directed the person entering upon the premises to leave the premises or has contacted law enforcement to make a report of unlawful squatting.
d.
No pending litigation exists between the owner of the premises and the person entering upon the premises.
A law enforcement agency shall not accept a report of unlawful squatting unless the report is made by an owner of the premises upon which the unlawful squatting occurred, or by an authorized representative of the owner of the premises upon which the unlawful squatting occurred.
Section 716.8, Code 2026, is amended by adding the following new subsection:

NEW SUBSECTION .
A law enforcement officer acting in good faith in response to a report of a violation of this section is immune from criminal and civil liability.

Unlawful squatting is a serious misdemeanor.
A person committing a trespass as provided in section 716.7, subsection 2, paragraph “a”, subparagraph (2A), commits the following:
(1) For a first offense, a serious misdemeanor.

A second offense of unlawful squatting is an aggravated misdemeanor.
A person providing a false document in response to a request to produce a document proving lawful authority is, in addition to any other criminal offense, guilty of a fraudulent practice under section 714.8.

A third or subsequent offense of unlawful squatting is a class “D” felony.

If a person who has entered upon the premises of another person knowingly provides a false document in response to a request to produce a document under subsection 2, paragraph “a”, subparagraph (4), or otherwise produces a false document as justification for the person’s presence on the premises, the person is guilty upon conviction of a class “D” felony.

A person aggrieved by a violation of this section is granted a private cause of action against the person who violated this section and is entitled to recover damages, including without limitation restitution, and reasonable attorney fees.

2629 EXPLANATION The inclusion of this explanation does not constitute agreement with the explanation’s substance by the members of the general assembly.
This bill establishes the criminal offense of unlawful squatting.
The bill provides that a person commits the offense of unlawful squatting if all of the following circumstances apply:
the person knowingly enters the premises of another person and resides on the premises of the other person for any period of time without lawful authority in entering and residing on the premises, and cannot produce any document authorizing the person’s presence;
the premises the person enters upon is not open to the public at the time of entry;
the owner of the premises has directed the person entering upon the premises to leave the premises or has contacted law enforcement to make a report of unlawful squatting;
and no pending litigation exists between the owner of the premises and the person entering upon the premises.
The bill provides that a law enforcement agency shall not accept a report of unlawful squatting unless the report is made by an owner of the premises upon which the unlawful squatting occurred, or by an authorized representative of the owner of the premises upon which the unlawful squatting occurred.

A second offense of unlawful squatting is an aggravated misdemeanor.
A third offense of unlawful squatting is a class “D” felony.
A person who provides a false document as justification for the person’s presence on the premises commits a class “D” felony.
A serious misdemeanor is punishable by confinement for no more than one year and a fine of at least $430 but not more than $2,560.
An aggravated misdemeanor is punishable by confinement for no more than two LSB 2111HV (3) 91 -3- as/js 3/4 H.F.
2629 years and a fine of at least $855 but not more than $8,540.
A class “D” felony is punishable by confinement for no more than five years and a fine of at least $1,025 but not more than $10,245.
The bill provides a private cause of action for a person aggrieved by a violation of the bill and the person is entitled to recover damages, including without limitation restitution, and reasonable attorney fees.
The bill provides definitions of “immediate family member”, “premises”, and “unlawful squatting”.
