Plain-language change summary

In the latest version of Senate File 394, a specific clause was removed that previously expressed that compliance with state law related to pesticide labeling would provide immunity from civil liability. The bill now clarifies that there is no prohibition against bringing a legal case based on other state laws regarding warnings and labeling. This change is significant because it allows individuals to seek legal recourse if they believe pesticide labels are insufficient, while still maintaining some protections for those using federally registered pesticides.

EXPLANATION The inclusion of this explanation does not constitute agreement with the explanation’s substance by the members of the general assembly.
This subsection shall not be interpreted to prohibit a cause of action based on any other provision or doctrine of state law.
This bill provides for a defense from civil liability associated with the use of pesticides that are registered with the United States environmental protection agency (EPA) acting under the federal Insecticide, Fungicide, and Rodenticide Act (federal Act).
SF 394 (2) 91 -1- da/ns/mb 1/1
The bill specifies that a label provides sufficient warning if it complies with any one of three criteria:
(1) it was approved by the EPA, (2) it is consistent with the most recent human health assessment performed under the federal Act, or (3) it is consistent with the EPA’s carcinogenicity classification for the pesticide.
In each case, the label is sufficient to satisfy any requirements for a warning or label regarding health or safety under Code chapter 206 (pesticide regulation), any other provision of state law concerning the duty to warn or label, or any other common law duty to warn.
