"Actual cash value" means the market value of the subject property of the personal automobile insurance policy immediately before it was damaged.
"Amount of loss" means:
(1) with regard to the repair of the vehicle, the cost to repair the damage to the subject property expressed monetarily in the context of the repair of a vehicle;
and (2) with regard to the value of the vehicle, the actual cash value of the vehicle.
"Disinterested" means an individual having no direct or indirect financial interest in the outcome of the appraisal.

"Umpire" means a neutral, disinterested individual with relevant experience in vehicle damage assessment, selected under paragraph (3) of subsection (b).
"Umpire" means a neutral, competent, and disinterested individual with relevant experience in vehicle damage assessment.
(1) Every automobile insurance policy issued, renewed, or delivered in Illinois that includes first-party coverage for physical damage shall contain a provision granting either the insured or the insurer the right to HB4160 Engrossed - 2 - LRB104 15794 BAB 28989 b invoke appraisal if there is a dispute over:
(1) Every policy of automobile insurance, as defined in subsection (a) of Section 143.13, issued, renewed, or delivered on or after July 1, 2027 in Illinois that includes first-party coverage for physical damage shall contain a provision granting the insured, in the insured's sole discretion, without the company's consent or agreement required, and the insurer the right to invoke appraisal if there is a dispute over the amount of a loss.

The Department shall maintain a list of competent and disinterested umpires and shall furnish that list to any party that requests the list.
(4) The 2 appraisers or, if there is a disagreement under paragraph (3), one appraiser and the umpire shall issue an award determining the amount of the loss.
If an umpire is selected pursuant to this Section, a final award shall be HB4160 Engrossed - 3 - LRB104 15794 BAB 28989 b determined within 5 calendar days after the umpire was selected.

This Act takes effect 90 days after becoming law.
