Summary

Beginning January 1, 2027, the act requires an agricultural employer to pay certain agricultural employees overtime pay for time worked in excess of 56 hours in a workweek. (1)(a)(I)(A) XCEPTASPROVIDEDINSUBSECTION (1)(a)(I)(OF THIS SECTION, if a case against an employer is enforced pursuant to section 8-4-111, anyemployer who without good faith legal justification failstopaythewagesof eachof theemployer'semployeesshallforfeitto the people of the state of Colorado a fine in an amount determined bythe director or hearing officer but no more than the sum of fifty dollars per day for each such failure to pay each employee, commencing from the date that such wages first became due and payable.
(1) (a) (I) (A)XCEPT AS PROVIDED IN SUBSECTION (1)(a)(I)(B)OF THIS SECTION, if a case against an employer is enforced pursuant to section 8-4-111, any employer who without good faith legal justification fails to pay the wages of each of the employer's employees shall forfeit to the people of the state of Colorado a fine in an amount determined by the director or hearing officer but no more than the sum of fiftydollars per day for each such failuretopayeachemployee,commencingfromthedate that such wages first became due and payable.
(B) FOR AN AGRICULTURAL EMPLOYER ,AS DEFINED IN SECTION -3- 121 8-3-104 (1), WHO ,WITHOUT A GOOD FAITH LEGAL JUSTIFICATION , WILLFULLY FAILS TO PAY THE WAGES OF EACH OF THE AGRICULTURAL EMPLOYER S EMPLOYEES AT LEAST THREE TIMES IN A FIYEAR PERIOD , THE TOTAL AMOUNT FORFEITED TO THE PEOPLE OF THE STATE OF C OLORADOPURSUANTTOSUBSECTION (1)(a)(I)(OFTHISSECTIONMAY BE INCREASED BY TEN PERCENT.

What does SB 121 do?
Beginning January 1, 2027, the act requires an agricultural employer to pay certain agricultural employees overtime pay for time worked in excess of 56 hours in a workweek. The act also increases penalties for an agricultural employer who commits wage theft and repeals the authority of the director of the division of labor standards and statistics to adopt rules concerning overtime pay for agricultural employees.(Note: This summary applies to this bill as enacted.)
