C ONCERNING THE USE OF GIFTS , GRANTS ,AND DONATIONS MADE TO THE DEPARTMENT OF HEALTH CARE POLICY AND FINANCING FOR THE PURPOSE OF ENHANCED REIMBURSEMENT FOR NURSING FACILITIES THAT SERVE RESIDENTS WITH BEHAVIORAL HEALTH NEEDS .
m A the purpose of providing support for the development and funding of an enhancedreimbursementmodelfor nursingfacilitiesthatserveresidents with behavioral health needs, the state department shall use the gifts, grants, and donations for that purpose.
Receiving gifts, grants, and donations for this purpose does not commit the state to an expenditure of general fund money, and the general assembly shall not reduce any appropriation made to the state department for the same purpose.

except that, if a referendum petition is filed pursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved by the people at the general election to be held in November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
