Leg Council FLOOR AMENDMENT EXPLANATION 1) Specifies that appropriated monies must be used by a recipient secure behavioral health residential facility (SBHRF) to:
a) construct a new SBHRF;
or b) retrofit an existing building for use as an SBHRF, subject to prior approval from the Arizona Health Care Cost Containment System (AHCCCS).
2) Prohibits a recipient SBHRF from providing treatment, at the same facility, to both civilly committed persons and committed persons, who have been adjudicated dangerous and incompetent to stand trial in a criminal proceeding.
3) Requires AHCCCS, in consultation with the Department of Administration, to issue a request for proposals for the SBHRFs by January 1, 2026.
4) Requires AHCCCS when distributing appropriated monies, in addition to prioritizing SBHRFs that can open within 1 year, to:
a) prioritize facilities that meet the geographic needs of Arizona;
b) consider an entity's experience in operating behavioral health facilities;
and c) consider the benefits of selecting one or multiple entities to receive appropriated monies.
5) Removes the requirement that there be a total of five recipient SBHRFs assigned between the three geographic service areas, as well as the allocation limit of $5,000,000 for each recipient SBHRF.
6) Requires AHCCCS to redact personally identifiable information received by SBHRFs when measuring and evaluating clinical outcomes, independent living functional and social outcomes, program specific metrics and physical health.
