WHEREAS the UnitedStates Congress enacted 43 U.S.C.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF ALASKA:
WHEREAS the United States Congress enacted 43 U.S.C.
and WHEREAS entities owned by federally recognized tribes in the state serve vital roles HJR044a -1- HJR 44 New Text Underlined [DELETED TEXT BRACKETED] 34-LS1588\N in promoting the economic development, self-governance, health, education, and welfare of Alaska Native communities;
and WHEREAS entities owned by federally recognized tribes in the state serve vital roles in promoting the economic development, self-governance, health, education, and welfare of -1- Enrolled HJR 44 Alaska Native communities;
and WHEREAS Alaska Native corporations and entities owned by federally recognized tribes in the state are expressly eligible to participate in the 8(a) Business Development Program under federal law in recognition of the federal government's trust responsibility to Alaska Natives and the unique circumstances of how the plenary powers of the United States Congress were exercised over the organizational structure of Alaska Natives;
and WHEREAS Alaska Native corporations and entities owned by federally recognized tribes in thestateareexpressly eligibletoparticipatein the8(a)Business Development Program under federal law in recognition of the federal government's trust responsibility to Alaska Natives and the unique circumstances of how the plenary powers of the United States Congress were exercised over the organizational structure of Alaska Natives;
and WHEREAS the 8(a) Business Development Program has proven to be an effective and efficient tool for federal agencies to meet mission needs while advancing the federal policy goals of economic inclusion and self-determination for Alaska Natives, including HJR 44 -2- HJR044a New Text Underlined [DELETED TEXT BRACKETED] 34-LS1588\N Alaska Native corporations and entities owned by federally recognized tribes in the state;
and WHEREAS the 8(a) Business Development Program has proven to be an effective and efficient tool for federal agencies to meet mission needs while advancing the federal policy goals of economic inclusion and self-determination for Alaska Natives, including Alaska Native corporations and entities owned by federally recognized tribes in the state;
and WHEREAS periodic proposals to restrict, eliminate, or undermine the participation of Alaska Native corporations and entities owned by federally recognized tribes in the state in the 8(a) Business Development Program threaten jobs in the state, rural economies, and the ability of Alaska Native corporations and entities owned by federally recognized tribes in the state to fulfill obligations to shareholders and tribal members;
and WHEREAS periodic proposals to restrict, eliminate, or undermine the participation of Enrolled HJR 44 -2- Alaska Native corporations and entities owned by federally recognized tribes in the state in the 8(a) Business Development Program threaten jobs in the state, rural economies, and the ability of Alaska Native corporations and entities owned by federally recognized tribes in the state to fulfill obligations to shareholders and tribal members;
and be it FURTHER RESOLVED that the Alaska State Legislature urges the President of the United States, the United States Congress, and the United States Small Business Administration to preserve, defend, and fully utilize the ability of Alaska Native corporations and entities owned by federally recognized tribes in the state to participate in the 8(a) Business Development Program and to oppose efforts that would weaken or eliminate its unique provisions applicable to Alaska Native corporations and entities owned by federally recognized tribes in the state;
and be it FURTHER RESOLVED that the Alaska State Legislature urges the President of the UnitedStates, theUnited States Congress, and the UnitedStates Small Business Administration to preserve, defend, and fully utilize the ability of Alaska Native corporations and entities owned by federally recognized tribes in the state to participate in the 8(a) Business Development Program and to oppose efforts that would weaken or eliminate its unique provisions applicable to Alaska Native corporations and entities owned byfederally recognized tribes in the state;
