THE DEPARTMENT SHALL ANNUALLY CONFIRMVERIFY EACH HOSPITAL'S COMPLIANCE WITH THIS SECTION.SECTION WITH THE CENTERS FOR MEDICARE AND MEDICAID SERVICES.
A HOSPITAL MUST ANNUALLY DEMONSTRATE TO THE DEPARTMENT, IN A MANNER PRESCRIBED BY THE DEPARTMENT, COMPLIANCE WITH THIS SUBSECTION.
A HOSPITAL THAT DOES NOT COMPLY WITH THIS SUBSECTION IS SUBJECT TO CIVIL PENALTIES AS PRESCRIBED IN SECTION 36-431.01.
ON OR BEFORE JANUARY 1, 2025 AND EACH JANUARY 1 THEREAFTER, THE DEPARTMENT SHALL POST A REPORT ON ITS PUBLIC WEBSITE CONTAINING EACHTHE HOSPITAL'SNAME LEVEL OF COMPLIANCEANY HOSPITAL THAT HAS BEEN FOUND TO BE NONCOMPLIANT WITH THE REQUIREMENTS OF SUBSECTION45 ACODE OF THISFEDERAL SECTION.REGULATIONS PART 180 AND THAT HAS BEEN ASSESSED A CIVIL MONETARY PENALTY BY THE CENTERS FOR MEDICARE AND MEDICAID SERVICES.
