2621 Be it enacted by the Legislature of the State of Arizona:
Section 1.
Prohibited settlement agreement or consent decree IN ANY CIVIL PROCEEDING IN A COURT OF COMPETENT JURISDICTION IN WHICH THE CONSTITUTIONALITY, LEGALITY OR APPLICATION OF ANY PROVISION OF THIS TITLE IS AT ISSUE, A PARTY THAT REPRESENTS THIS STATE OR AN AGENCY OR POLITICAL SUBDIVISION OF THIS STATE MAY NOT AGREE TO OR SIGN A SETTLEMENT AGREEMENT OR CONSENT DECREE." THE APPROVAL BY THE LEGISLATIVE COUNCIL MUST OCCUR IN A PUBLIC HEARING WHERE THERE IS AN OPPORTUNITY FOR PUBLIC TESTIMONY.
THIS SECTION DOES NOT APPLY TO ANY PROVISION OF CHAPTER 6, ARTICLE 2 OF THIS TITLE.
