The legislature further finds that the enactment of positive legislation establishing guidelines for public employment relations is the best way to harness and direct the energies of public employees and child day care providers eager to have a voice in determining their conditions of work, to provide a rational method for dealing with disputes and HB0149bHB0149a -1- CSHBHB 149(FIN)149 New Text Underlined [DELETED TEXT BRACKETED] 32-LS0474\B32-LS0474\A work stoppages, to strengthen the merit principle where civil service is in effect, and to maintain a favorable political and social environment.
(a) The labor relations agency shall investigate a petition if it is submitted in a manner prescribed by the labor relations agency and is (1) by an employee, a [OR] group of employees, a child day care CSHBHB 149(FIN)149 -2- HB0149bHB0149a New Text Underlined [DELETED TEXT BRACKETED] 32-LS0474\B32-LS0474\A provider, a group of child day care providers, or an organization acting in their behalf alleging that 30 percent of the employees or child day care providers in [OF] a proposed bargaining unit (A) want to be represented for collective bargaining by a labor, [OR] employee, or child day care provider organization as exclusive representative, or (B) assert that the organization that [WHICH] has been certified or is currently being recognized by the public employer as bargaining representative is no longer the representative of the majority of employees or child day care providers in the bargaining unit;

(c) An [A LABOR OR EMPLOYEE] organization or its agents may not (1) restrain or coerce (A) an employee or child day care provider in the exercise of the rights guaranteed in AS 23.40.080, or (B) a public employer in the selection of the employer's representative for the purposes of collective bargaining or the adjustment of CSHBHB 149(FIN)149 -4- HB0149bHB0149a New Text Underlined [DELETED TEXT BRACKETED] 32-LS0474\B32-LS0474\A grievances;
Upon submission of proper proof of religious conviction to the labor relations agency, the agency shall declare the employee or child day care provider exempt from becoming a member of HB0149bHB0149a -5- CSHBHB 149(FIN)149 New Text Underlined [DELETED TEXT BRACKETED] 32-LS0474\B32-LS0474\A a labor organization or employee association.
(3) changes a child day care provider's legal status apration,aspration, sole proprietorship, or other legal entity;
(5) prohibits a child day care provider from communicating or attempting to communicate with a public employer or another person;person.
(6) requires an employee or child day care provider to become a member of an organization that represents child care providers.

(1) "collective bargaining" means the performance of the mutual HB 149 -6- HB0149a New Text Underlined [DELETED TEXT BRACKETED] 32-LS0474\A obligation of the public employer or the employer's designated representatives and the representative of the employees or child day care providers to meet at reasonable times, including meetings in advance of the budget making process, and negotiate in good faith with respect to wages, hours, and other terms and conditions of employment, or the negotiation of an agreement, or negotiation of a question arising under an agreement and the execution of a written contract incorporating an agreement reached if requested by either party, but these obligations do not compel either party to agree to a proposal or require the making of a concession;

AS 37.14 is amended by adding a new section to read:

Child Day Care Provider Fund.
Sec.
37.14.850.
Child day care provider fund established.
(a) The child day care provider fund is established as a separate fund in the state treasury for the purpose of implementing the monetary terms of an agreement applicable to child day care providers entered into under AS 23.40.070 - 23.40.260.
Money in the fund does not lapse.
The fund consists of (1) money appropriated to the fund;
(2) income earned on investment of fund assets;
and (3) donations to the fund.
(b) The legislature may annually appropriate money from the fund to implement the monetary terms of an agreement applicable to child day care providers entered into under AS 23.40.070 - 23.40.260.
(c) Nothing in this section creates a dedicated fund.
