The updated version of HB 12 makes important changes to how courts handle requests for protective orders. Firstly, it clarifies that a court cannot deny a protective order simply because of a delay in filing after a sexual assault or domestic violence incident, and this includes cases that have already received a protective order or were previously denied relief. Additionally, it introduces a provision allowing petitioners to request an extension of a protective order within a specific timeframe before or after it expires, ensuring ongoing protection for victims. These amendments aim to strengthen support for survivors by reducing obstacles in obtaining necessary legal protection.
