and providing for an effective date."date. 07 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF ALASKA:
0806 _______________ 07 * Section 1.
0908 (1) "aggravated sex offense" means 1009 (A) a crime under AS 11.41.100(a)(3), or a similar law of 1110 another jurisdiction, in which the person committed or attempted to commit a 1211 sexual offense, or a similar offense under the laws of the other jurisdiction;
in 1312 this subparagraph, "sexual offense" has the meaning given in AS 11.41.100(a)(3);
09 (a) A member of the militia who commits any of the following acts is guilty of 10 sexual assault and, except as provided under (g) of this section, shall [MAY] be 11 punished [BY UP TO 10 YEARS OF CONFINEMENT,] by separation with 12 characterization [UP TO] dishonorable discharge[,]discharge [,] and may, in addition to 13 separation, be punished by up to 10 years of confinement and by such other 14 punishment as a court-martial may direct:
02 (g) The convening authority of the court-martial may reduce, commute, or 03 suspend a sentence of separation with characterization dishonorable discharge 04 imposed by a court-martial under (a) of this section to a sentence of separation with 05 characterization badbad-conduct conductdischarge if, after sentencing and before the entry of 06 judgment, the 06 accused provides substantial assistance with the investigation or 07 prosecution of 07 another person.
33 of this Act, AS 26.05.900(d),26.05.900(d)(7) 10 and (8), enacted by sec.
36 of this Act, 11 AS 26.05.940 11 and 26.05.945, enacted by sec.
38 of this Act, and AS 26.05.990(22), enacted 12 by sec.
39 of 12 this Act, apply to offenses committed on or after the effective date of secs.
1010, 13 12 - 34, 36, 38, 13 and 39 of this Act.
