   An Act requiring the New Jersey Motor Vehicle Commission to issue special windshield stickers for electric vehicles 1[, amending R.S.39:1-1,]1 and supplementing Title 39 of Revised Statutes.
       1.    R.S.39:1-1 is amended to read as follows:

P.L.2022, c.16, s.2)        2.  (New section)  a.  The Chief Administrator of the New Jersey Motor Vehicle Commission shall issue special windshield stickers indicating that a vehicle owned or leased and registered in this State is an electric vehicle, as defined pursuant to R.S.39:1-1, and is, therefore, exempt from emission inspections, pursuant to regulations adopted under chapter 20 of Title 13 of the New Jersey Administrative Code.  The stickers shall be designed by the chief administrator, in consultation with the Director of the Division of Highway Traffic Safety in the Department of Law and Public Safety.  There shall be no fee for the issuance of the stickers.

       b.    The stickers shall be displayed in a manner prescribed by the chief administrator, in consultation with the Director of the Division of Highway Traffic Safety in the Department of Law and Public Safety, and shall be clearly visible to law enforcement officers.       c.     The stickers shall be removed and returned to the New Jersey Motor Vehicle Commission within 30 days of the termination of the ownership or leasehold period of the electric vehicle.         3.    (New section)  The chief administrator, in consultation with the Director of the Division of Highway Traffic Safety in the Department of Law and Public Safety, shall adopt, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), regulations specifying the size, placement, and other formal requirements or additional safeguards as the chief administrator deems necessary for the issuance and display of the special windshield stickers, as required pursuant to section 2 of P.L.    , c.     (C.        ) (pending before the Legislature as this bill).         4.
     b.1   The Chief Administrator of the New Jersey Motor Vehicle Commission shall issue special windshield stickers indicating that a vehicle owned or leased and registered in this State is an electric vehicle, as defined pursuant to 1[R.S.39:1-1] subsection a.
 This act shall take effect on the first day of the 13th month following enactment, but the Chief Administrator of the New Jersey Motor Vehicle Commission may take such anticipatory actions as may be necessary for the timely implementation of this act.

      STATEMENT        This bill requires the Chief Administrator (chief administrator) of the New Jersey Motor Vehicle Commission (commission) to issue special windshield stickers for electric vehicles that are owned or leased and registered in New Jersey to indicate that the electric vehicles are exempt from emission inspections.  The bill defines “electric vehicle” to mean any vehicle powered solely by electric without an on-board engine or generator, and that does not use a hydrocarbon fuel to create electricity.  Electric vehicle includes a plug-in electric, but not plug-in hybrid electric, or solar-powered vehicle.       Under the bill, the windshield stickers are to be designed by the chief administrator, in consultation with the Director of the Division of Highway Traffic Safety in the Department of Law and Public Safety (director).  There is to be no fee for the issuance of the windshield stickers.       The windshield stickers are required to be displayed in a manner prescribed by the chief administrator, in consultation with the director, and to be clearly visible to law enforcement officers.  The windshield stickers are required to be removed and returned to the commission within 30 days of the date that the ownership or leasehold period of the vehicle has ended.       The bill requires the chief administrator, in consultation with the director, to adopt regulations specifying the size, placement, and other formal requirements or additional safeguards as the chief administrator deems necessary for the issuance and display of the windshield stickers.  
       1[b] c1.      The stickers shall be displayed in a manner prescribed by the chief administrator, in consultation with the Director of the Division of Highway Traffic Safety in the Department of Law and Public Safety, and shall be clearly visible to law enforcement officers.       1[c] d1.      The stickers shall be removed and returned to the New Jersey Motor Vehicle Commission within 30 days of the termination of the ownership or leasehold period of the electric vehicle.         1[3.  (New section)] 2.1  The chief administrator, in consultation with the Director of the Division of Highway Traffic Safety in the Department of Law and Public Safety, shall adopt, pursuant to the “Administrative Procedure Act,” P.L.1968, c.410 (C.52:14B-1 et seq.), regulations specifying the size, placement, and other formal requirements or additional safeguards as the chief administrator deems necessary for the issuance and display of the special windshield stickers, as required pursuant to section 1[2] 11 of P.L.    , c.    (C.        ) (pending before the Legislature as this bill).         1[4.] 3.1  This act shall take effect on the first day of the 13th month following enactment, but the Chief Administrator of the New Jersey Motor Vehicle Commission may take such anticipatory actions as may be necessary for the timely implementation of this act.
