     (4)  With respect to parking spaces for people with disabilities, the model land use ordinance published pursuant to section 4 of P.L.2021, c.171 (C.40:55D-66.21) shall include standards that provide for the progression of accessible Make-Ready parking spaces to accessible electric vehicle supply equipment parking spaces, and shall conform to the requirements of the most recent "International Building Code" and "International Residential Code" published by the International Code Council except as the Commissioner of Community Affairs deems appropriate to deviate from those codes.

    STATEMENT        This bill amends section 3 of P.L.2021, c.171 (C.40:55D-66.20) to clarify the calculation and application of electric vehicle (EV) parking space credits.
     Current law provides that parking spaces prepared with EV supply equipment or Make-Ready equipment may count as at least two parking spaces for purposes of satisfying minimum parking requirements, subject to a limitation that the credits may not reduce the total required parking by more than 10 percent.  Current law also requires that EV parking space calculations be rounded up when they result in a fraction of a whole number.
     A recent court decision identified ambiguity in the interaction between these provisions, particularly in circumstances where rounding a fractional EV parking space calculation would cause the resulting credit to exceed the statutory 10 percent limitation.
     This bill clarifies that EV parking space calculations that include a fractional number are to be rounded up to the next whole parking space, provided that the resulting credit does not exceed the 10 percent limitation set forth in the law.
     The bill also clarifies that EV parking space credits are to be applied during the concept plan review stage for purposes of determining consistency with a redevelopment plan or other development plan adopted pursuant to law, including a master plan or zoning-based development plan.
     By clarifying these provisions, the bill is intended to promote greater certainty and consistency in the application of existing statutory requirements by developers and municipal reviewing bodies.
