The amended bill now specifies that a person who violates its provisions will face a civil penalty of $500 for a first offense and $1,000 for any subsequent offense, assessed per day of the violation. This follows the prior phrasing that characterized violations as unlawful practices under the consumer fraud act without detailing specific penalties. Additionally, the amendment includes a provision stating that these civil penalties will be collected by the director in a summary proceeding, providing clarity on enforcement.
