Under existing law, each manufacturer, bottler, packager, wholesale drug distributor, or other entity in the supply chain for pharmaceutical products is required to obtain an annual permit from the Board of Pharmacy and pay an annual permit fee.
This bill would require each holder of a permit to designate a representative of the permit holder and would require the representative to register with the board and pay an additional annual registration fee.
A BILL TO BE ENACTED AN ACT Relating to the Board of Pharmacy;
Section 34-23-32 of the Code of Alabama Page 1 HB79 INTRODUCED 1975, is amended to read as follows:
(1) The fee shall not be less than five hundred dollars Page 1 HB79 Enrolled ($500) nor more than two thousand dollars ($2,000) for a new establishment.
(c) The professional practice of any physician licensed to practice medicine is exempt from the requirements of this Page 2 HB79 INTRODUCED section.
For each application for a permit made and found to be satisfactory by the board, the secretary of the board shall issue to the applicant a permit for such appropriate function, which permit shall be displayed in a Page 2 HB79 Enrolled conspicuous place.
If the Page 3 HB79 INTRODUCED renewal is not timely received by the board, the applicant for renewal of the registration shall pay a penalty of not more than fifty dollars ($50) for each month the renewal is late, as set by rule of the board.
(e)(f) All holders of a permit shall, before shipping any drug bearing the legend, "caution, federal law prohibits dispensing without prescription" or similar wording causing these drugs to be known as legend drugs to new customers, assure themselves that the recipient is either a duly licensed doctor of medicine, dentistry, or veterinary medicine or holds 95 a registered pharmacy permit from the board by contacting the Page 3 HB79 Enrolled office of the board.
95 (g)(h) The holder of a permit to ship any legend drug or device into the state shall provide to the board a list of all trading partners, upon request of the board.
Any person violating this section shall be Page 4 HB79 INTRODUCED guilty of a misdemeanor.
