Require that, as part of the conditions for civil penalties to be barred for the voluntary disclosure of a violation of KRS Chapter 77 or 224 and the administrative regulations promulgated thereunder, the violation not be part of a pattern of violations occurring in the past five years at a facility or facilities owned by the same entity.
