Plain-language change summary

The amendments to SB 379 change the nature of the proposed tax credit for parents of stillbirths from being refundable to nonrefundable. This means that instead of receiving a refund if the credit exceeds the amount of taxes owed, parents can only use the credit to reduce their tax liability. Additionally, some language regarding appropriations and details about the credit's eligibility was removed, which simplifies the bill but may limit the financial benefit to families who qualify. These changes could impact the level of support that grieving families receive during a challenging time.

relating to:
creating a refundable individual income tax credit for the parent of a stillbirth and making an appropriation.
Analysis by the Legislative Reference Bureau This bill creates a refundable individual income tax credit of $2,000 that may be claimed by the parents of a stillbirth.
The bill defines “stillbirth” as a birth that occurs in this state that results in a stillbirth for which a fetal death report is required.
Because the credit is refundable, if the amount of the credit for which the individual is eligible exceeds his or her tax liability, the difference will be refunded to the claimant.
For further information see the state fiscal estimate, which will be printed as an appendix to this bill.
