Section 13510.8 of the Penal Code
SEC. 1.5. Section 13510.8 of the Penal Code is amended to read: (4) (A) For purposes of an applicant to attend the basic course who was previously employed as a sworn law enforcement officer or individual contractor and personally engaged in immigration enforcement, the commission shall deny suitability for enrollment in the basic course, unless the commission receives notice from a hiring agency granting their suitability.(B) No applicant described in subparagraph (A) shall enter the basic course without a hiring agency granting their suitability.(C) Suitability shall be based off of both of the following:(i) The standards the commission shall adopt by regulation that shall serve as the criteria for suitability that a hiring agency will consider when considering suitability of an applicant that shall include whether an applicant personally assisted in immigration enforcement and to what degree.(ii) The standards established for peace officers under all applicable California laws and regulations, including, but not limited to, those set forth in Section 1031 of the Government Code and this section.(D) Suitability shall be determined on a case-by-case basis based off of information contained in the applicant’s background check and any additional information the commission deems relevant. (10) Theft, pursuant to subdivision (a) of Section 484, committed by a peace officer under color of authority, where the peace officer acted with specific intent to permanently deprive the owner of the property and the conduct was not the result of mere negligence, administrative oversight, or good-faith error in evidence handling.
