Title 75 of the Pennsylvania Consolidated Statutes
§ 1120. Digital titling system. The department shall create a digital titling system that allows for the electronic submission of registration and title documents from dealers for initial registration and titling and the transfer of ownership of a vehicle. The system shall be implemented by qualified and currently contracted electronic registration vendors already approved by the department. The following shall apply: (1) The system shall include the following: (i) A digitization of all forms required for title and registration, which shall: (A) be performed by the qualified vendor in consultation with the department; and (B) allow for the forms to be submitted without notarization. (ii) The use of electronic signatures on all required title and registration forms that are required to be submitted for titling and registering a vehicle in this Commonwealth. The following shall apply: (A) The department: (I) may require a document containing an electronic signature to include an indication that the signature is electronic; (II) shall not require an electronic signature process or an electronic signature vendor to be certified by the department before accepting a document that is executed with an electronic signature; (III) shall not require a document that has been executed with an electronic signature to be converted to physical format by printing for any purpose, except when submission by physical means is necessary and required; (IV) shall not impose any additional requirement upon an electronic signature; and (V) may require a certification of authenticity, audit trail or similar statement or proof of assurance. (B) If a signature on a document is required by law and the document is submitted electronically, the signature requirement is satisfied by an authenticated, electronically submitted signature. (C) An electronically submitted document, once accepted by the department, is deemed the same as an original document and is admissible in all administrative, quasi-judicial and judicial proceedings. (iii) Real-time access for motor vehicle records to facilitate vehicle purchases and vehicle transfers using the department's motor vehicle record as the primary source of accuracy. Verification, in a manner as prescribed by the department, of the department's system of record shall negate the need for a dealer to have the physical title in hand before selling a vehicle in a vehicle transaction. (2) The department shall provide the vendor with support during testing and implementation. (3) The vendor shall bear all costs associated with the development, implementation, training and ongoing management of any improvements made to the department's electronic registration system. (4) An electronic odometer disclosure as part of the titling or registration of a vehicle must meet the provisions under 49 U.S.C. § 32705(g) (relating to disclosure requirements on transfer of motor vehicles). (5) The department may allow a person to submit a document required under this chapter by using electronic media deemed feasible by the department in lieu of an original document. If a signature on a document is required by law and the document is submitted electronically, the signature requirement is satisfied by an authenticated signature submitted electronically. An electronically submitted document, once accepted by the department, is deemed the same as an original document and is admissible in all administrative, quasi-judicial and judicial proceedings.
This creates a new section in the Pennsylvania vehicle laws outlining a digital system for titling and registration, enhancing efficiency in vehicle transactions.
