2.
Section 694.1, Code 2019, is amended by adding the following new subsection:
NEW SUBSECTION.
“Veteran-at-risk”Information meansdisseminated ato veteran as defined in section 35.1 or an active duty member of the armedpublic forcesthrough of the Unitedmass States,notification aand memberemergency ofmessaging asystem reserveshall componentbe thereof,limited or a member of the national guard who, based on the information provided by a person filing a complaint pursuant to sectionimminent 694.2,emergency isand apublic veteransafety-related orissues. member with a physical or mental health condition related to the military service of the veteran or member.
For purposes of this section, a “public safety-related issue” includes the circumstances described in subsection 3A.
The department may provide access to the system for use at the county and local level.
Access by a county or local government shall be at the department’s sole discretion, and if approved by the department, shall be under the control of the local commission.
The commission shall establish an operational plan and procedure which meets standards adopted by the department by rule, and shall submit the operational plan and procedure for approval by the department prior to access being granted.
Additional access criteria and procedures for administering the fund shall be established by the department by rule.

694.5A Green alert program for missing veterans-at-risk.
1.
For purposes of this section:
a.
“Department” means the department of public safety.
b.
“Green alert” means a public alert program for missing veterans-at-risk.
TheSection department29C.17A, shallCode establish2019, ais greenamended alertby toadding require a law enforcement agency that receives a report of a missing person involving a veteran-at-risk to submit a request for a public alert to the statefollowing patrolnew assubsection: soon as practicable.
TheNEW departmentSUBSECTION shall. implement activation procedures for a green alert by the same mechanisms currently used by the department for the public alert program for missing and abducted children.

The department shall developadopt rules to utilize the criteriamass notification and emergency messaging system to benotify usedthe inpublic determiningabout whetheran aendangered greenmissing alertperson, shalltogether bewith issuedinformation bythat thecould stateassist patrol.in locating and providing help to such a person.
TheFor departmentpurposes shallof developthis thesubsection, criteria“endangered inmissing collaborationperson” withmeans thea departmentperson of veteransany affairs,age thewho commissionis ofmissing, veteranswho affairs,may be in danger due to the Unitedperson’s Statesage departmentor ofphysical veteransor affairs,mental thehealth departmentor ofdue humanto services,severe weather conditions, and thewho Iowamay associationbe ofunable broadcasters.to return to safety without assistance.
The“Endangered criteriamissing shallperson” includeincludes, butwithout notlimitation, bea limitedveteran as defined in section 35.1 or an active duty member of the armed forces of the United States, a member of a reserve component thereof, or a member of the national guard, who has a physical or mental health condition related to the following:military service of the veteran or member and who may be missing as a result of that condition.

A report of a missing veteran-at-risk must be provided LSB 1144XS (5) 88 -1- mo/rh 1/3 S.F.
64 to a law enforcement agency within seventy-two hours of the veteran-at-risk’s disappearance.
b.
There is reason to believe the veteran-at-risk may be missing as a consequence of a physical or mental health condition related to the veteran-at-risk’s military service.
c.
There is sufficient information available to disseminate a green alert to the public that could assist in locating the missing veteran-at-risk.

The department shall develop and disseminate to Iowa law enforcement agencies a form to be used in submitting a request to the state patrol for a green alert.

The commissioner of public safety shall adopt rules pursuant to chapter 17A consistent with the purposes of this section.

This bill relates to the creation of a green alert program for missing veterans-at-risk.
The bill adds “veteran-at-risk” to the definition of a “missing person” under Code section 694.1.
A “veteran-at-risk” is defined as a veteran or an active duty member of the armed forces of the United States, a member of a reserve component thereof, or a member of the national guard who, based on the information provided by a person filing a complaint pursuant to Code section 694.2, is a veteran or member with a physical or mental health condition related to the military service of the veteran or member.
Under Code sections 694.2 and 694.3, a person may file a complaint of a missing person with a law enforcement agency and the law enforcement agency is required to prepare, as soon as practicable, a report on the missing person.
Upon completion of the report, the law enforcement agency must disseminate the report to other law enforcement agencies pursuant to Code section 694.4.
The bill directs the department of public safety to LSB 1144XS (5) 88 -2- mo/rh 2/3 S.F.
64 establish a green alert, which is defined in the bill as a public alert program for missing veterans-at-risk, requiring a law enforcement agency that receives a report of a missing person involving a veteran-at-risk to submit a request for a public alert to the state patrol as soon as practicable.
The green alert shall be implemented in a substantially similar fashion as the activation procedures used for an AMBER alert pursuant to administrative rules of the department of public safety relating to missing and abducted children.
The bill requires the department of public safety to develop the criteria to be used by the state patrol in determining whether a green alert shall be issued.
The criteria shall include but not be limited to the following:
(1) a report of a missing veteran-at-risk must be provided to a law enforcement agency within 72 hours of the veteran-at-risk’s disappearance;
(2) there is reason to believe the veteran-at-risk may be missing as a consequence of a physical or mental health condition that is related to the veteran-at-risk’s military service;
and (3) there is sufficient information available to disseminate a green alert to the public that could assist in locating the missing veteran-at-risk.
The bill requires the department of public safety to develop and disseminate to law enforcement agencies a form to be used in submitting a request to the state patrol for a green alert, and requires the department of public safety to adopt rules consistent with the provisions of the bill.
