Code chapter 232 defines a “child” as any person under the age of 18.
“Incarcerated” means to be imprisoned by placing a person in a jail, prison, penitentiary, juvenile facility, or other correctional institution or facility or a place or condition of confinement or forcible restraint regardless of the nature of the institution in which the person serves a sentence for a conviction.

“Incarcerated” does not mean placement in an adult residential correctional or treatment facility that allows a resident to leave the facility for a portion of a day or days.
The bill provides exceptions for a child living with a parent or guardian who is a sex offender required to register or on the sex offender registry, a child living with a parent or guardian who is married to and living with a sex offender required to register or on the sex offender registry, and a child who is a sex offender required to register or on the sex offender registry who is living with the child’s parent, guardian, or foster parent and is also living with the child to whom access was allowed.
Sec.
