TO ESTABLISH THE CYBER SECURITY FUND WITHIN THE STATE TREASURY TO BE ADMINISTERED BY THE DEPARTMENT OF INFORMATION TECHNOLOGY WITH INPUT FROM CRITICAL GOVERNMENT STAKEHOLDERS FOR THE PURPOSE OF UPGRADING THEIR INFORMATION TECHNOLOGY INFRASTRUCTURE TO STRENGTHEN THE STATE ANDLOCALITIESAGAINSTCYBERATTACKSANDAPPROPRIATINGFUNDSANDLOCALITIESAGAINSTCYBERATTACKSANDAPPROPRIATING FUNDS FOR THAT PURPOSE;

– Any person whose property or person is injured by reason of a violation of this section may sue for and recover treble damages, costs, and attorneys' fees from the person who committed the violation of this section and any person who acts as an accessory *DRH40347-ML-66A* General Assembly Of North Carolina Session 2023 before or after the fact, aids or abets, solicits, conspires, or lends material support to the violation of this section.

TheCyberSecurityTheCyberSecurityFund Fund shall consist ofappropriations from theGeneral Fund,federal funds granted to the State to protect the State's cybersecurity infrastructure, and funds from local political subdivisions appropriated directly to the Fund for cybersecurity programs.
(3) To ensure organizational personnel are appropriatelyappropriatelytrained trained to provide robust responses to cyber threats and incidents.

SECTION 2.(c) Unless prohibited by federal law, federal funds provided during the 2023-2025 fiscal biennium to the State to implement the State and Local Cybersecurity Grant Program (SLCGP) as enacted in the Infrastructure Investment and Jobs Act of 2021, Public Law 117-58, shall be credited to the Cyber SecuritySecurityFund. Fund.
SECTION 2.(d) Effective JulyJuly1, 1, 2023, there is appropriated from the General Fund to the Cyber Security Fund the sum of twenty-five million dollars ($25,000,000) for the 2023-2024 fiscal year and the sum of twenty-five million dollars ($25,000,000) for the 2024-2025 fiscal year to fund State and local government cybersecurity efforts to strengthen government information technology infrastructure against the risk of cyberattacks.
The Utility Securitization Trust Fund shall consist of appropriations from the General Fund, federal funds granted to the State to protect the State's public utility infrastructure, and funds from local political subdivisions appropriated directlydirectlyto to the Fund for public utilityutilitysecuritization securitization programs.
The State Treasurer shall hold the Fund separate and apart from House Bill 671-First Edition Page 3 General Assembly Of North Carolina Session 2023 all other moneys, funds, and accounts.
