Local Government, if favorable, Judiciary 1, if favorable, Transportation, if favorable, Education - K-12, if favorable, Rules, Calendar, and Operations of the House March 25, 2021 A BILL TO BE ENTITLED AN ACT TO AUTHORIZE THE CITY OF DURHAM TO ESTABLISH A PILOT PROGRAM FOR THE USE OF ELECTRONIC SPEED-MEASURING SYSTEMS TO DETECT SPEED LIMIT VIOLATIONS IN SCHOOL ZONES.
The notice shall be delivered by first-class United States mail at the address on the current registration of *H388-v-1* General Assembly Of North Carolina Session 2021 the vehicle's owner and is deemed served on the registered owner five days after the mailing.

NotificationNotificationofCriminal of Criminal Charges.
– IfIfalaw a law enforcement officer,officercites, pursuant to G.S.
20-141.1,15A-302, citesorarrests,pursuant orto arrests an owner or operator of a vehicle, in accordance with G.S.
15A-30215A-401,anowneror oroperatorofavehicle in an area where an electronic speed-measuring system is in use for detecting violations of a speed limit set pursuant to G.S.

Upon notificationnotification, of criminal charges, the City of Durham shall not issue a notificationnotice of violation underpursuant to Section 6 of this act.
If it is determined that thea notificationnotice of violation was issued in error after proper notificationnotification, of criminal charges, no penalty may be imposed under this act, and any penalty already paid pursuant to the notice of violation shall be refunded.
– A person dissatisfied with the decision of the City of Durham under Section 11 of this act may appeal the decision to the district court of the county in which the violation occurred by filing a notice of the appeal with the clerk of superior court in Page 2 House Bill 388-First Edition General Assembly Of North Carolina Session 2021 the county where the violation occurred within 30 days of notification of a final decision by the City of Durham.
