The recent amendments to HB 35 change the conditions under which a peace officer can make an arrest for aggravated domestic assault. Now, officers can arrest someone if they believe there's imminent danger of physical harm to the non-aggressor, rather than being required to make an arrest solely upon establishing probable cause. Additionally, the classification of aggravated domestic assault has been clarified, with specific penalties outlined based on prior convictions. These changes are significant because they aim to improve the protection of victims in domestic violence situations and provide law enforcement with clearer guidelines for taking action.
