"High-speed broadband service." Any wireline or fixed wireless technology having the capacity to transmit data from or to the Internet at minimum speeds of at least 25 megabits per second downstream and 3 megabits per second upstream.
(1) MINIMUM SPEEDS OF AT LEAST 25 MEGABITS PER SECOND DOWNSTREAM AND THREE MEGABITS PER SECOND UPSTREAM;

"Overbuild." The deployment of high-speed broadband service infrastructure in an area where high-speed broadband service <-- infrastructure has been deployed and high-speed broadband services are offered to the public at the time of submitting a grant application THAT IS NOT UNSERVED.

20190SB0835PN1800 - 8 - (II) THE AUTHORITY SHALL EXECUTE A GRANT AGREEMENT BETWEEN THE BOARD AND A GRANT RECIPIENT BEFORE THE PAYMENT OF A GRANT AWARD.
(v) A grant recipient shall submit to the authority a final report of the project, including any information as required by the board.
(III) A GRANT RECIPIENT SHALL MAINTAIN FULL AND ACCURATE RECORDS FOR THE PROJECT.
(2) The authority may establish additional requirements for the program as the authority deems necessary to 20190SB0835PN2112 - 8 - administer the program.
(IV) A GRANT RECIPIENT SHALL SUBMIT TO THE AUTHORITY COPIES OF ALL CANCELED CHECKS OR OTHER RECORDS VERIFYING EXPENDITURES OF GRANT MONEY.
(b) Restrictions and limitations.--The following apply:
(V) A GRANT RECIPIENT SHALL SUBMIT TO THE AUTHORITY A FINAL REPORT OF THE PROJECT, INCLUDING ANY INFORMATION AS REQUIRED BY THE BOARD.
(1) A grant recipient may not commence work on a project before receiving authority approval of the grant under section 6.
(2) THE AUTHORITY MAY ESTABLISH ADDITIONAL REQUIREMENTS FOR THE PROGRAM AS THE AUTHORITY DEEMS NECESSARY TO ADMINISTER THE PROGRAM.
Commencement of work prior to receiving authority approval will result in a project application being ineligible for funding consideration.
(B) RESTRICTIONS AND LIMITATIONS.--THE FOLLOWING APPLY:
(2) A grant recipient may not make a substantial change to an approved project without first obtaining authority consent in writing.
(1) A GRANT RECIPIENT MAY NOT COMMENCE WORK ON A PROJECT BEFORE RECEIVING AUTHORITY APPROVAL OF THE GRANT UNDER SECTION 6.
(3) Any unused portion of a grant award shall be returned to the authority.
COMMENCEMENT OF WORK PRIOR TO RECEIVING AUTHORITY APPROVAL WILL RESULT IN A PROJECT APPLICATION BEING INELIGIBLE FOR FUNDING CONSIDERATION.
(4) Grant money may only be used for new projects approved by the board.
(2) A GRANT RECIPIENT MAY NOT MAKE A SUBSTANTIAL CHANGE TO AN APPROVED PROJECT WITHOUT FIRST OBTAINING AUTHORITY CONSENT IN WRITING.
(5) Grant money may not be used for any of the following:

(i) Paying fees for securing financing.

(iii) Refinancing existing debt.
(I) PAYING FEES FOR SECURING FINANCING.
(iv) Paying for lobbying services.

(6) The authority may establish additional restrictions and limitations as the authority deems necessary to administer the program.

(3) Money in the account is continuously appropriated to the account.
(I) APPROPRIATIONS, INCLUDING FEDERAL MONEY.
This appropriation shall not lapse at the end of a fiscal year.
(II) RETURN ON THE MONEY IN THE ACCOUNT.
(d) Guidelines.--Within 180 days of the effective date of this section, the board shall adopt guidelines to implement this section.
(3) MONEY IN THE ACCOUNT IS CONTINUOUSLY APPROPRIATED TO THE ACCOUNT.
The guidelines shall include provisions for submission, review and approval of applications, award of grants and administration of projects funded under the program, including a provision for reasonable oversight and reporting to ensure that project grant awards are used as intended.
THIS APPROPRIATION SHALL NOT LAPSE AT THE END OF A FISCAL YEAR.
(e) Prohibition.--The authority may not provide, by <-- regulation or otherwise, for third-party audit requirements, liquidated damages provisions or provisions that are not reasonably related to the deployment of high-speed broadband service infrastructure by an applicant in accordance with the purposes and provisions of this act.
(D) GUIDELINES.--WITHIN 180 DAYS OF THE EFFECTIVE DATE OF THIS SECTION, THE BOARD SHALL ADOPT GUIDELINES TO IMPLEMENT THIS SECTION.
(f) (E) Construction.--Nothing in this section shall be <-- construed to preclude the authority from considering an applicant's financial ability to complete a proposed project or making reasonable requests for information necessary for the oversight and administration of projects awarded grant funding.
THE GUIDELINES SHALL INCLUDE PROVISIONS FOR SUBMISSION, REVIEW AND APPROVAL OF APPLICATIONS, AWARD OF GRANTS AND ADMINISTRATION OF PROJECTS FUNDED UNDER THE PROGRAM, INCLUDING A PROVISION FOR REASONABLE OVERSIGHT AND REPORTING TO ENSURE THAT PROJECT GRANT AWARDS ARE USED AS INTENDED.

APPROPRIATION.
The sum of $5,000,000 is hereby appropriated to the authority from the General Fund for the 2020-2021 fiscal year for purposes of the program.

(a) Prohibition.--The Department of Revenue may not award a tax credit under Article XVIII-E of the act of March 4, 1971 (P.L.6, No.2), known as the Tax Reform Code of 1971, after June 30, 2020.
(A) PROHIBITION.--THE DEPARTMENT OF REVENUE MAY NOT AWARD A TAX CREDIT UNDER ARTICLE XVIII-E OF THE ACT OF MARCH 4, 1971 (P.L.6, NO.2), KNOWN AS THE TAX REFORM CODE OF 1971, AFTER JUNE 30, 2020.
(b) Repeals.--Repeals are as follows:
(B) REPEALS.--REPEALS ARE AS FOLLOWS:
(1) The General Assembly declares that the repeal under paragraph (2) is necessary to effectuate this act.
