The amendment to House Bill 3 clarifies the process for filling judicial vacancies when the Governor or General Assembly is unable to act. Notably, it gives the Chief Justice the authority to make appointments if the General Assembly is not in session or has not provided nominees. This change matters because it helps ensure that judicial positions can be filled without unnecessary delays, maintaining the functionality of the court system.
