Nursing delegation by a registered professional nurse.
The University of Illinois Hospital must make reasonable efforts to have activated at all times the closed captioning feature on a television in a common area provided for use by the general public or in a patient's room or to enable the closed captioning feature when requested to do so by a member of the general public or a patient if the television includes a closed captioning feature.
(a) For the purposes of this Section:
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the University of Illinois Hospital's staff after such feature is enabled in a common area or in a patient's room unless the deactivation of the closed captioning feature is knowing or intentional.
"Delegation" means transferring to a specific individual the authority to perform a specific nursing intervention in a specific situation.
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the general public, a patient, or a member of the University of Illinois Hospital's staff at the request of a patient of the University of Illinois SB0309 Engrossed - 2 - LRB100 05111 SMS 15121 b Hospital.
"Predictability of outcomes" means that a registered professional nurse or advanced practice registered nurse has determined that the patient's or individual's clinical status is stable and expected to improve or the patient's or individual's deteriorating condition is expected to follow a known or expected course.
If the University of Illinois Hospital does not have a television that includes a closed captioning feature, then the University of Illinois Hospital must ensure that all televisions obtained for common areas and patient rooms after the effective date of this amendatory Act of the 100th General Assembly include a closed captioning feature.
"Stability" means a registered professional nurse or advanced practice registered nurse has determined that the individual's clinical status and nursing care needs are consistent.
This Section does not affect any other provision of law relating to disability discrimination or providing reasonable accommodations or diminish the rights of a person with a disability under any other law.
SB0309 Enrolled - 2 - LRB100 05111 SMS 15121 b (b) This Section authorizes a registered professional nurse or advanced practice registered nurse to:
As used in this Section, "closed captioning" means a text display of spoken words presented on a television that allows a deaf or hard of hearing viewer to follow the dialogue and the action of a program simultaneously.
(1) delegate nursing interventions to other registered professional nurses, licensed practical nurses, and other unlicensed personnel based on the comprehensive nursing assessment that includes, but is not limited to:

(2) delegate medication administration to other licensed nurses;
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the alternative health care model's staff after such feature is enabled in a common area or in a patient's room unless the deactivation of the closed captioning feature is knowing or intentional.
(3) in community-based or in-home care settings, delegate the administration of medication (limited to oral or subcutaneous dosage and topical or transdermal application) to unlicensed personnel, if all the conditions for delegation set forth in this Section are met;
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the general public, a patient, or a member of the alternative health care model's staff at the request of a patient of the alternative health care model licensed under this Act.
(4) refuse to delegate, stop, or rescind a previously authorized delegation;
If the alternative health care model licensed under this Act does not have a television that includes a closed captioning feature, then the alternative health care model licensed under this Act must ensure that all televisions obtained for common areas and patient rooms after the effective date of this amendatory Act of the 100th General Assembly include a closed captioning feature.
or (5) in community-based or in-home care settings, delegate, guide, and evaluate the implementation of nursing interventions as a component of patient care SB0309 Enrolled - 3 - LRB100 05111 SMS 15121 b coordination after completion of the comprehensive patient assessment based on analysis of the comprehensive nursing assessment data;
This Section does not affect any other provision of law relating to disability discrimination or providing reasonable accommodations or diminish the rights of a person with a disability under any other law.

(c) This Section prohibits the following:

(1) An individual or entity from mandating that a registered professional nurse delegate nursing interventions if the registered professional nurse determines it is inappropriate to do so.
The Ambulatory Surgical Treatment Center Act is amended by adding Section 7c as follows:
Nurses shall not be subject to disciplinary or any other adverse action for refusing to delegate a nursing intervention based on patient safety.
(210 ILCS 5/7c new) Sec.
(2) The delegation of medication administration to unlicensed personnel in any institutional or long-term facility, including, but not limited to, those facilities licensed by the Hospital Licensing Act, the University of Illinois Hospital Act, State-operated mental health hospitals, or State-operated developmental centers, except as authorized under Article 80 of this Act or otherwise specifically authorized by law.
7c.
(3) A registered professional nurse from delegating nursing judgment, the comprehensive patient assessment, the development of a plan of care, and the evaluation of care to licensed or unlicensed personnel.

(4) A licensed practical nurse or unlicensed personnel SB0309 Enrolled - 4 - LRB100 05111 SMS 15121 b who has been delegated a nursing intervention from re-delegating a nursing intervention.
An ambulatory surgical treatment center licensed under this Act must make reasonable efforts to have activated at all times the closed captioning feature on a television in a common area provided for use by the general public or in a patient's room, or enable the closed captioning feature when requested to do so by a member of the general public or a patient, if the television includes a closed captioning feature.

It is not a violation of this Section if the closed captioning feature is deactivated by a member of the ambulatory surgical treatment center's staff after such feature is enabled in a common area or in a patient's room unless the deactivation of the closed captioning feature is knowing or intentional.

It is not a violation of this Section if the closed captioning feature is deactivated by a member of the facility's staff after such feature is enabled in a common area or in a resident's room unless the deactivation of the closed captioning feature is knowing or intentional.
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the general public, a resident, or a member of the facility's staff at the request of a resident of a facility licensed under this Act.

It is not a violation of this Section if the closed captioning feature is deactivated by a member of the facility's staff after such feature is enabled in a common area or in a resident's room unless the deactivation of the closed captioning feature is knowing or intentional.

A facility licensed under this Act must make reasonable efforts to have activated at all times the closed captioning feature on a television in a common area provided for use by the general public or in a consumer's room, or enable the closed captioning feature when requested to do so by a member of the general public or a consumer, if the television includes a closed captioning feature.
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the facility's SB0309 Engrossed - 12 - LRB100 05111 SMS 15121 b staff after such feature is enabled in a common area or in a consumer's room unless the deactivation of the closed captioning feature is knowing or intentional.
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the general public, a consumer, or a member of the facility's staff at the request of a consumer of a facility licensed under this Act.
If a facility licensed under this Act does not have a television in a common area that includes a closed captioning feature, then the facility licensed under this Act must ensure that all televisions obtained for common areas after the effective date of this amendatory Act of the 100th General Assembly include a closed captioning feature.
This Section does not affect any other provision of law relating to disability discrimination or providing reasonable accommodations or diminish the rights of a person with a disability under any other law.
Nothing in this Section shall apply to televisions that are privately owned by a resident or third party and not owned by the facility.

Section 45.
The Hospital Licensing Act is amended by adding Section 11.8 as follows:

A hospital licensed under this Act must make reasonable efforts to have activated at all times the closed captioning feature on a television in a common area provided for use by the general public or in a patient's room, or enable the closed captioning feature when requested to do so by a member of the general public or a patient, if the television includes a closed captioning feature.
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the hospital's staff after such feature is enabled in a common area or in a patient's room unless the deactivation of the closed captioning feature is knowing or intentional.
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the general public, a patient, or a member of the hospital's staff at the request of a patient of a hospital licensed under this Act.
If a hospital licensed under this Act does not have a television that includes a closed captioning feature, then the hospital must ensure that all televisions obtained for common areas and patient rooms after the effective date of this amendatory Act of the 100th General Assembly include a closed captioning feature.

The Community-Integrated Living Arrangements Licensure and Certification Act is amended by adding Section 10.5 as follows:

Closed captioning required.
A community-integrated living arrangement certified under this Act must make reasonable efforts to have activated at all times the closed captioning feature on a television in a common area provided for use by the general public or in a resident's room, or enable the closed captioning feature when requested to do so by a member of the general public or a resident, if the television includes a closed captioning feature.
It is not a violation of this Section if the closed captioning feature is deactivated by a member of the community-integrated living arrangement's staff after such feature is enabled in a common area or in a resident's room unless the deactivation of the closed captioning feature is knowing or intentional.
It is not a violation of this Section SB0309 Engrossed - 15 - LRB100 05111 SMS 15121 b if the closed captioning feature is deactivated by a member of the general public, a resident, or a member of the community-integrated living arrangement's staff at the request of a resident of a community-integrated living arrangement certified under this Act.
If a community-integrated living arrangement certified under this Act does not have a television in a common area that includes a closed captioning feature, then the community-integrated living arrangement certified under this Act must ensure that all televisions obtained for common areas after the effective date of this amendatory Act of the 100th General Assembly include a closed captioning feature.
