Plain-language change summary

The recent changes to Bill SB 154 removed a section that defined the term "designated sponsor" and its associated roles in the context of electronic monitoring in long-term care facilities. Instead, the bill now focuses on clarifying the definitions of "attorney in fact," "guardian," and "long-term care facility." This shift may simplify the legislation and concentrate more on the monitoring policies, which could enhance resident safety and oversight in such care settings. Overall, these amendments emphasize the importance of improving resident rights while streamlining the regulations related to electronic monitoring.

The bill amends existing sections of the Ohio Revised Code to clarify and regulate the installation and use of electronic monitoring devices in long-term care facilities.

  • 3721.65

discharged discharge from a long-term care facility or otherwise discriminated discriminate or retaliated retaliate against a person or resident because of the decision to authorize the installation and use of an electronic monitoring device in a resident's room in the facility. → discharge from a long-term care facility or otherwise discriminate or retaliate against a person or resident because of the decision to authorize the installation and use of an electronic monitoring device in a resident's room in the facility.

This change corrects repeated words to streamline the legal language regarding discrimination and retaliation.

  • 3721.61

the cost of the device and the cost of installing, maintaining, and removing the device, other than the cost of electricity for the device, is paid for by the resident or the resident's guardian or attorney in fact. → the cost of the device and the costs of installing, maintaining, and removing the device are paid for by the resident or the resident's guardian or attorney in fact.

This change clarifies that the resident or their representatives are responsible for device costs, removing the reference to electricity.

  • 3721.63

A long-term care facility may prescribe a form for use by a resident or resident's guardian or attorney in fact seeking to authorize the installation and use of an electronic monitoring device in the resident's room in a long-term care facility. → A long-term care facility may prescribe a form for use by a resident or resident's guardian or attorney in fact seeking to authorize the installation and use of an electronic monitoring device in the resident's room.

This amendment shortens the description of the form used for authorization.

  • 3721.60

as defined in section 3721.01 of the Revised Code. → as defined in section 3721.01 of the Revised Code, and also includes a residential care facility.

This addition clarifies that 'long-term care facility' definitions include residential care facilities.
