Summary

Amends the Regional Planning Act. Removes provisions relating to the Chicago Metropolitan Agency for Planning's Wastewater Committee. Provides that approval of four-fifths of the Board of the Chicago Metropolitan Agency for Planning members in office is necessary for the Board to take action regarding Agency budget and work plan approval, regional plan approval, annual federally funded program approval, legislative agenda approval, and approval of any matter regarding the executive director, but action on all other matters shall be taken in accordance with the Board's bylaws. Provides that the Board shall continue directly involving local elected officials in federal program allocation decisions for any other federally suballocated funding as required by law (rather than only directly involving local elected officials in federal program allocation decisions for the Surface Transportation Program and Congestion Mitigation and Air Quality funds). Repeals provisions relating to succession and transfers related to the Northeastern Illinois Planning Commission and a transition period of the Board. Provides that each General Assembly shall appropriate dedicated funding to the Chicago Metropolitan Agency for Planning to fulfill those functions and programs authorized by the Act (rather than additional funding shall be provided to the Agency to support those functions and programs authorized by the Act). Makes other changes.

The Regional Planning Act is amended by changing Sections 10, 15, 25, and 60 as follows:
(70 ILCS 1707/10) Sec.
10.
"Board" means the Board of the Chicago Metropolitan Agency for Planning.
As used in this Act:
"CMAP" means the Chicago Metropolitan Agency for Planning.
"Corporate authorities" means the corporate authorities of Tinley Park - Park District.
"Chief elected county official" means the Board Chair Chairman in DuPage, Kane, Kendall, Lake, and McHenry Counties and the County Executive in Will County.
"Department" means the Department of Central Management Services.
"Fiscal year" means the fiscal year of the State.
"Director" means the Director of Central Management Services.
"IDOT" means the Illinois Department of Transportation.
"TPPD" means the Tinley Park - Park District, a body corporate and politic of Cook and Will Counties, Illinois.
"MPO" means the metropolitan planning organization designated under 23 U.S.C.

"Members" means the members of the Board.
Pursuant to the provisions and subject to all of the terms and conditions of this Act, the Director, on behalf of the State of Illinois, is authorized to execute and deliver to TPPD, for and in consideration of $1 paid to the Department, a quitclaim deed to the following described real property and a quitclaim bill of sale to all the existing tangible personal property on the real property, and such ancillary documents as the Department deems appropriate, for fully and properly effectuating a transfer to TPPD of the title to the Tinley Park Mental Health Center and Howe HB5078 Enrolled - 2 - LRB103 38280 AWJ 68415 b Developmental Center, described as follows:
"Person" means an individual, partnership, firm, public or private corporation, State agency, transportation agency, or unit of local government.
PARCEL 1 THAT PART OF SECTION 36, TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL MERIDIAN, LYING SOUTHERLY OF THE SOUTHERLY LINE OF THE CHICAGO, ROCK ISLAND AND PACIFIC RAILROAD, [EXCEPTING THEREFROM THAT PORTION DESCRIBED AS FOLLOWS:
"Policy Committee" means the decision-making body of the MPO.

Section 15.
(6) The terms of those members appointed, with the consent of the President of the Cook County Board of Commissioners, by the mayors representing those communities in Cook County that are outside of the City of Chicago, south of Interstate 55, and west of Interstate 57, excluding the communities of Summit, Dixmoor, Posen, Robbins, Midlothian, Oak Forest, and Tinley Park, shall expire on July 1, 2007.
Transfer to TPPD.
(7) The terms of those members appointed, with the consent of the President of the Cook County Board of Commissioners, by the mayor representing those communities in Cook County that are outside of the City of Chicago, south of Devon Avenue, and north of Interstate 55, and, in addition, the Village of Summit, shall expire on July 1, 2009.
(a) The corporate authorities of the TPPD, situated in Cook and Will Counties, have determined that it is in the best interest of TPPD and its residents to acquire the presently unoccupied and unused combined campuses of the Tinley Park Mental Health Center and Howe Developmental Center, hereinafter referred to collectively as the Combined Campuses, including not only the land but also the several dozen existing structures, the existing utility facilities and other HB5078 Enrolled - 8 - LRB103 38280 AWJ 68415 b improvements above, at or below grade level, and all existing tangible personal property there, which Combined Campuses are presently owned by the State of Illinois, and for TPPD to pursue a redevelopment of that property.
(8) The terms of those members appointed, with the consent of the President of the Cook County Board of Commissioners, by the mayors representing those HB5078 Engrossed - 9 - LRB103 38280 AWJ 68415 b communities in Cook County that are outside of the City of Chicago and east of Interstate 57, and, in addition, the communities of Dixmoor, Posen, Robbins, Midlothian, Oak Forest, and Tinley Park, shall expire on July 1, 2009.
(b) Notwithstanding any other law of the State of Illinois to the contrary, the Director is authorized under this Act to sell all right, title, and interest of the State of Illinois in and to the Combined Campuses for $1 and such other terms and conditions in the quitclaim deed, the quitclaim bill of sale, and ancillary documents that the Director deems appropriate, with such sale occurring pursuant to a Purchase and Sale Agreement prepared by the Department.
(b) If a vacancy occurs, the appropriate appointing authority shall fill the vacancy by an appointment for the unexpired term.
The conveyance of the Property authorized by this Act shall be made subject to existing public roads, existing rights of public utilities, existing rights of the public or quasipublic utilities, and any and all reservations, easements, encumbrances, covenants, agreements, and restrictions of record.
Board members shall receive no compensation, but shall be reimbursed for expenses incurred in the performance of their duties.
(c) Each of the documents of transfer shall state on its face and be subject to the conditions that the Property (i) shall be used for public purposes only, including recreation and conservation, and (ii) shall not be used for the purpose of gambling authorized by the Illinois Horse Racing Act of 1975 or the Illinois Gambling Act, and the documents of transfer shall each contain a reverter clause providing, in language prepared by and acceptable to the Department, that title to the Property shall revert, without further action, to the HB5078 Enrolled - 9 - LRB103 38280 AWJ 68415 b State of Illinois if:
(c) The Board shall be so appointed as to represent the City of Chicago, that part of Cook County outside the City of Chicago, and that part of the metropolitan region outside of Cook County on a one person man one vote basis.

Within 6 months after the release of each certified federal decennial census, the Board shall review its composition and, if a change is necessary in order to comply with the representation requirements of this subsection (c), shall recommend the necessary revision for approval by the General Assembly.

(d) Regular meetings of the Board shall be held at least once in each calendar quarter.

The time and place of Board meetings shall be fixed by resolution of the Board.
Section 20.
Special meetings of the Board may be called by the chair chairman or a majority of the Board members.

A written notice of the time and place of any special meeting shall be provided to all Board members at least 3 days prior to the date fixed for the meeting, except that if the time and place of a special meeting HB5078 Engrossed - 10 - LRB103 38280 AWJ 68415 b is fixed at a regular meeting at which all Board members are present, no such written notice is required.

A majority of the Board members in office constitutes a quorum for the purpose of convening a meeting of the Board.
The transfer of title authorized under this Act shall be by quitclaim deed and quitclaim bill of sale, which shall be prepared by the Department so that the transfer is on an "AS IS", "WHERE IS", and "WITH ALL FAULTS" basis as of the date of sale, without any representation by the State of Illinois to TPPD, or any persons and entities whatsoever, as to Property's condition or fitness for any purpose.
(e) The meetings of the Board shall be held in compliance with the Open Meetings Act.
Both the deed and bill of sale shall be executed by TPPD as grantee in order to confirm the TPPD's undertakings to abide by the requirements in this Act and TPPD's agreement to timely and fully perform its obligations as set forth in this Act.
The Board shall maintain records in accordance with the provisions of the State Records Act.
All documents of transfer shall be recorded in the county in which the Property is located.
(f) At its initial meeting and its first regular meeting after July 1 of each year thereafter, the Board from its membership shall appoint a chair chairman and may appoint vice chairs chairmen and shall provide the term and duties of those officers pursuant to its bylaws.
Section 99.
Before entering upon duties of office, the chair chairman shall execute a bond with corporate sureties to be approved by the Board and shall file it with the principal office of the Board.
Effective date.
The bond shall be payable to the Board in whatever penal sum may be directed and shall be conditioned upon the faithful performance of the duties of office and the payment of all money received by the chair chairman according to law and the orders of the Board.
This Act takes effect upon becoming law.
The Board may appoint, from time to time, an executive committee and standing and ad hoc committees to assist in carrying out its responsibilities.
(g) Open meetings of the Board shall be broadcast to the public and maintained in real-time on the Board's website using a high-speed Internet connection.
Recordings of each meeting broadcast shall be posted to the Board's website HB5078 Engrossed - 11 - LRB103 38280 AWJ 68415 b within a reasonable time after the meeting and shall be maintained as public records to the extent practicable, as determined by the Board.
Compliance with the provisions of this amendatory Act of the 100th General Assembly does not relieve the Board of its obligations under the Open Meetings Act.

60.
Transportation decision-making.
(a) The Policy Committee is the federally designated Metropolitan Planning Organization for the Chicago region under the requirements of federal regulations promulgated by USDOT.
The Policy Committee shall approve all plans, reports, and programs required of an MPO, including the federally mandated Regional Transportation Plan, Transportation Improvement Program and Unified Work Program.
(b) It is the intent of this Act that the transportation planning and investment decision-making process be fully integrated into the regional planning process.
(c) The Board, in cooperation with local governments and transportation providers, shall develop and adopt a process for making the transportation decisions that require final MPO approval pursuant to federal law.
That process shall comply with all applicable federal requirements.
The adopted process shall ensure that all MPO plans, reports, and programs shall HB5078 Engrossed - 12 - LRB103 38280 AWJ 68415 b be approved by the CMAP Board prior to final approval by the MPO.
(d) The Board shall continue directly involving local elected officials in federal program allocation decisions for the Surface Transportation Program, and Congestion Mitigation and Air Quality funds, and any other federally suballocated funding as required by law and in addressing other regional transportation issues.

What does HB 5078 do?
Amends the Regional Planning Act. Removes provisions relating to the Chicago Metropolitan Agency for Planning's Wastewater Committee. Provides that approval of four-fifths of the Board of the Chicago Metropolitan Agency for Planning members in office is necessary for the Board to take action regarding Agency budget and work plan approval, regional plan approval, annual federally funded program approval, legislative agenda approval, and approval of any matter regarding the executive director, but action on all other matters shall be taken in accordance with the Board's bylaws. Provides that the Board shall continue directly involving local elected officials in federal program allocation decisions for any other federally suballocated funding as required by law (rather than only directly involving local elected officials in federal program allocation decisions for the Surface Transportation Program and Congestion Mitigation and Air Quality funds). Repeals provisions relating to succession and transfers related to the Northeastern Illinois Planning Commission and a transition period of the Board. Provides that each General Assembly shall appropriate dedicated funding to the Chicago Metropolitan Agency for Planning to fulfill those functions and programs authorized by the Act (rather than additional funding shall be provided to the Agency to support those functions and programs authorized by the Act). Makes other changes.
