The recent amendments to Bill SB 2237 clarify the process by which communications providers can gain permission to use highway rights-of-way. The changes specify that consent can be granted based on an application, with terms set by the highway authority to protect public interests. Additionally, it now mandates that if the highway authority does not own the property outright, the applicant must compensate property owners for any damages caused by using the highway. This transparency and protection for property owners are important to ensure fair use of public resources.
