Summary

Amends the Retailers' Occupation Tax Act. Provides that a retailer is relieved from liability for any tax that becomes due and payable if the tax is represented by amounts that are found to be worthless or uncollectible and have been charged off in accordance with generally accepted accounting principles on and after July 1, 2014. Provide for a deduction if the retailer had previously paid such a tax. Effective immediately.

Plain-language change summary

The amendment to SB 3397 clarifies how retailers and purchasers can claim refunds for taxes or penalties paid in error. It emphasizes that retailers can only receive refunds if they actually bore the burden of the tax, meaning they didn't pass the cost onto someone else. This change matters because it prevents retailers from collecting refunds for taxes they effectively charged to customers, which can help ensure fairness in tax collection and compliance.
