Sections 1073(e)(2)(ix) and 1164 of the act of <-- March 10, 1949 (P.L.30, No.14), known as the Public School Code of 1949, are amended to read:

SECTION 1164 OF THE ACT OF MARCH 10, 1949 <-- (P.L.30, NO.14), KNOWN AS THE PUBLIC SCHOOL CODE OF 1949, IS AMENDED TO READ:
Section 1164.
"School administrator" shall mean any employe of the school entity below the rank of district superintendent, executive director, director of career and technical school, assistant district superintendent or assistant executive director, but including [the rank of first level supervisor] an individual with a supervisory or administrative certificate from the Department of Education, who by virtue of assigned duties is not in a bargaining unit of public employes as created under the act of July 23, 1970 (P.L.563, No.195), known as the "Public Employe 20240HB2581PN3730 - 2 - Relations Act." However, this definition shall not apply to anyone who has the duties and responsibilities of the position of business manager or personnel director[, but not to include 20240HB2581PN3641 - 2 - principals].
20240HB2581PN3730 - 3 - (2) Salary amounts or a salary schedule.
20240HB2581PN3641 - 3 - (5) A prohibition on school administrators being disciplined or discharged without just cause.
(g) If a school administrator has a concern about the school administrator's performance or other administrative rights as specified in an agreement, the school administrator shall be 20240HB2581PN3730 - 4 - entitled to the following appeal process:
(1) Upon written request from the school administrator, the district superintendent shall meet with the school administrator 20240HB2581PN3641 - 4 - in an attempt to resolve the issue in question.
The school administrator may choose to be represented at the meeting by another school administrator covered under an agreement or by a member of the school 20240HB2581PN3730 - 5 - administrator's professional organization.
(i) If a school administrator is summoned to attend a meeting by the school administrator's supervisor in which the 20240HB2581PN3641 - 5 - solicitor or another attorney is present on behalf of the school employer, the school administrator shall have the right to reschedule the meeting until the school administrator is able to obtain legal representation.
(j) A school administrator shall not be compensated at a rate less than the school administrator would receive as a teacher in a school district through appropriate placement on the school district's collective bargaining agreement and salary schedule, taking into account years of experience in education andand, level of education.education AND DAYS WORKED ON AN ANNUAL BASIS.
