The latest version of HB 5233 introduces stricter penalties for falsely advertising synthetic drug products, escalating the consequences to a Class 3 felony, which can carry a fine of up to $100,000. Additionally, the language was modified to clarify that individuals who follow specific guidelines, demonstrating good faith in their actions, may avoid penalties if they can prove their innocence regarding misbranding issues. These changes aim to deter misleading advertising while ensuring that honest businesses are not unfairly punished.
