(1) This section is the tax preference performance statement for the tax preference contained in section 2, chapter .
RCW 46.55.130 and 2017 c 152 s 2 are each amended to read as follows:(1) If, after the expiration of fifteen days from the date of mailing of notice of custody and sale required in RCW 46.55.110(3) to the registered and legal owners, the vehicle remains unclaimed and has not been listed as a stolen vehicle, a suspended license impound has been directed but no commercially reasonable tender has been paid under RCW 46.55.120, or a person eligible to redeem under RCW 46.55.120(1)(a)(viii) has not come forth providing information that the registered or legal owner of a motorcycle or moped is an admitted patient in a hospital, the registered tow truck operator having custody of the vehicle shall conduct a sale of the vehicle at public auction after having first published a notice of the date, place, and time of the auction, and a method to contact the tow truck operator conducting the auction such as a telephone number, email address, or web site, in a newspaper of general circulation in the county in which the vehicle is located not less than three days and no more than ten days before the date of the auction.

For the purposes of this section, a newspaper of general circulation may be a commercial, widely circulated, free, classified advertisement circular not affiliated with the registered tow truck operator and the notice may be listed in a classification delineating "auctions" or similar language designed to attract potential bidders to the auction.
This performance statement is only intended to be used for subsequent evaluation of the tax preference.
The notice shall contain a notification that a public viewing period will be available before the auction and the length of the viewing period.
It is not intended to create a private right of action by any party or to be used to determine eligibility for preferential tax treatment.(2) The legislature categorizes this tax preference as one intended to provide tax relief to certain businesses or individuals as indicated in RCW 82.32.808(2)(e).(3) It is the legislature's specific public policy objective to allow registered tow truck operators to recoup their expenditures associated with removing abandoned vehicles from the roads and highways of Washington.(4) If a review finds that the average cost of towing, storing, and disposing of an abandoned vehicle exceeds the average revenue of the sale of an abandoned vehicle by an amount greater than the value of the retail sales and use tax authorized in section 2 of this act, then the legislature intends to extend the expiration date of this tax preference.(5) In order to obtain the data necessary to perform the review in subsection (4) of this section, the joint legislative audit and review committee may refer to any data collected by the state.Sec.
The auction shall be held during daylight hours of a normal business day.

The viewing period must be one hour if twenty-five or fewer vehicles are to be auctioned, two hours if more than twenty-five and fewer than fifty vehicles are to be auctioned, and three hours if fifty or more vehicles are to be auctioned.
RCW 82.04.040 and 2017 c 323 s 201 are each amended to read as follows:(1) Except as otherwise provided in this subsection, "sale" means any transfer of the ownership of, title to, or possession of property for a valuable consideration and includes any activity classified as a "sale at retail" or "retail sale" under RCW 82.04.050.
If the registered tow truck operator is notified that the registered or legal owner of the moped or motorcycle is an admitted patient in the hospital as evidenced by a declaration on a form authorized by the department, the registered tow truck operator may delay the auction of the moped or motorcycle for a reasonable time in a good faith effort to provide additional time for the redemption of the vehicle.(2) The following procedures are required in any public auction of such abandoned vehicles:(a) The auction shall be held in such a manner that all persons present are given an equal time and opportunity to bid;(b) All bidders must be present at the time of auction unless they have submitted to the registered tow truck operator, who may or may not choose to use the preauction bid method, a written bid on a specific vehicle.
It includes lease or rental, conditional sale contracts, and any contract under which possession of the property is given to the purchaser but title is retained by the vendor as security for the payment of the purchase price.
Written bids may be submitted up to five days before the auction and shall clearly state which vehicle is being bid upon, the amount of the bid, and who is submitting the bid;(c) The open bid process, including all written bids, shall be used so that everyone knows the dollar value that must be exceeded;(d) The highest two bids received shall be recorded in written form and shall include the name, address, and telephone number of each such bidder;(e) In case the high bidder defaults, the next bidder has the right to purchase the vehicle for the amount of his or her bid;(f) The successful bidder shall apply for title within fifteen days;(g) The registered tow truck operator shall post a copy of the auction procedure at the bidding site.
It also includes the furnishing of food, drink, or meals for compensation whether consumed upon the premises or not.
If the bidding site is different from the licensed office location, the operator shall post a clearly visible sign at the office location that describes in detail where the auction will be held.
The term "sale" does not include the transfer of the ownership of, title to, or possession of:(a) An animal by an animal rescue organization in exchange for the payment of an adoption fee;
At the bidding site a copy of the newspaper advertisement that lists the vehicles for sale shall be posted;(h) The moneys derived from the auction, up to the amount of the registered tow truck operator's lien, shall constitute a payment of the accumulated towing and storage charges and not consideration for the transfer of ownership, title, or possession of the vehicle.
or(b) An abandoned vehicle sold by a registered tow truck operator to a successful bidder at public auction or, if there is no successful bidder, to a licensed vehicle wrecker, hulk hauler, or scrap processor, as provided in RCW 46.55.130.
All surplus moneys derived from the auction after satisfaction of the registered tow truck operator's lien shall be remitted within thirty days to the department for deposit in the state motor vehicle fund.
Nothing in this subsection (1)(b) may be construed as providing an exemption from:(i) The tax imposed by chapter 82.12 RCW on the use of an abandoned vehicle by any consumer;
A report identifying the vehicles resulting in any surplus shall accompany the remitted funds.
or(ii) Taxes imposed under this chapter and chapter 82.08 RCW on automobile towing and automobile storage services provided by a registered tow truck operator.(2) "Casual or isolated sale" means a sale made by a person who is not engaged in the business of selling the type of property involved.(3)(a) "Lease or rental" means any transfer of possession or control of tangible personal property for a fixed or indeterminate term for consideration.
If the director subsequently receives a valid claim from the registered vehicle owner of record as determined by the department within one year from the date of the auction, the surplus moneys shall be remitted to such owner;(i) If an operator receives no bid, or if the operator is the successful bidder at auction, the operator shall, within forty-five days, sell the vehicle to a licensed vehicle wrecker, hulk hauler, or scrap processor by use of the abandoned vehicle report-affidavit of sale, or the operator shall apply for title to the vehicle.(3) A tow truck operator may refuse to accept a bid at an abandoned vehicle auction under this section for any reason in the operator's posted operating procedures and for any of the following reasons:
A lease or rental may include future options to purchase or extend.
(a) The bidder is currently indebted to the operator;
"Lease or rental" includes agreements covering motor vehicles and trailers where the amount of consideration may be increased or decreased by reference to the amount realized upon sale or disposition of the property as defined in 26 U.S.C.
(b) the operator has knowledge that the bidder has previously abandoned vehicles purchased at auction;

or (c) the bidder has purchased, at auction, more than four vehicles in the last calendar year without obtaining title to any or all of the vehicles.
7701(h)(1), as amended or renumbered as of January 1, 2003.
In no case may an operator hold a vehicle for longer than ninety days without holding an auction on the vehicle, except for vehicles that are under a police or judicial hold.(4)(a) The accumulation of storage charges applied to the lien at auction under RCW 46.55.140 may not exceed fifteen additional days from the date of receipt of the information by the operator from the department as provided by RCW 46.55.110(3) plus the storage charges accumulated prior to the receipt of the information.
The definition in this subsection (3) must be used for sales and use tax purposes regardless if a transaction is characterized as a lease or rental under generally accepted accounting principles, the United States internal revenue code, Washington state's commercial code, or other provisions of federal, state, or local law.(b) "Lease or rental" does not include:(i) A transfer of possession or control of property under a security agreement or deferred payment plan that requires the transfer of title upon completion of the required payments;(ii) A transfer of possession or control of property under an agreement that requires the transfer of title upon completion of required payments, and payment of an option price does not exceed the greater of one hundred dollars or one percent of the total required payments;
However, vehicles redeemed pursuant to RCW 46.55.120 prior to their sale at auction are subject to payment of all accumulated storage charges from the time of impoundment up to the time of redemption.(b) The failure of the registered tow truck operator to comply with the time limits provided in this chapter limits the accumulation of storage charges to five days except where delay is unavoidable.
or(iii) Providing tangible personal property along with an operator for a fixed or indeterminate period of time.
Providing incorrect or incomplete identifying information to the department in the abandoned vehicle report shall be considered a failure to comply with these time limits if correct information is available.
A condition of this exclusion is that the operator is necessary for the tangible personal property to perform as designed.
However, storage charges begin to accrue again on the date the correct and complete information is provided to the department by the registered tow truck operator.--- END ---
For the purpose of this subsection (3)(b)(iii), an operator must do more than maintain, inspect, or set up the tangible personal property.(4)(a) "Adoption fee" means an amount charged by an animal rescue organization to adopt an animal, except that "adoption fee" does not include any separately itemized charge for any incidental inanimate items provided to persons adopting an animal, including food, identification tags, collars, and leashes.(b) "Animal care and control agency" means the same as in RCW 16.52.011 and also includes any similar entity operating outside of this state.(c) "Animal rescue group" means a nonprofit organization that:(i)(A) Is exempt from federal income taxation under 26 U.S.C.
Sec.
501(c) of the federal internal revenue code as it exists on July 23, 2017;
or(B) Is registered as a charity with the Washington secretary of state under chapter 19.09 RCW, whether such registration is required by law or voluntary;(ii) Has as its primary purpose the prevention of abuse, neglect, cruelty, exploitation, or homelessness of animals;
and(iii) Exclusively obtains dogs, cats, or other animals for placement that are:(A) Stray or abandoned;(B) Surrendered or relinquished by animal owners or caretakers;(C) Transferred from other animal rescue organizations;
or(D) Born in the care of such nonprofit organization other than through intentional breeding by the nonprofit organization.(d) "Animal rescue organization" means an animal care and control agency or an animal rescue group.NEW SECTION.  Sec.
