Provides that emergency services, with respect to an emergency medical condition, include, as it relates to any mental health services or substance abuse services rendered at a behavioral health crisis service provider, (i) a behavioral health assessment that is within the capability of a behavioral health crisis service provider, including ancillary services routinely available to evaluate such emergency medical condition, and (ii) such further examination and treatment, to the extent that they are within the capabilities of the staff and facilities available at the behavioral health crisis service provider, as are required so that the patient's condition does not deteriorate. D§ A.38.2-3412.1.
Coverage for mental health and substance use disorders.
A.

"Alcohol or drug rehabilitation facility" means a facility in which a state-approved program for the treatmentState Board of alcoholismHealth pursuant to Chapter 5 (§ 32.1-123 et seq.) of Title 32.1 or drugby addictionthe isDepartment provided.ofe Behavioral Health and Developmental Services pursuant to Article 2 (§ 37.2-403 et seq.) of Chapter 4 of Title 37.2 or (ii) a state agency or institution.
The"Child facilityor shalladolescent" bemeans eitherany (i)person licensedunder by the Stateage Board of Health19 pursuantyears. to Chapter 5 (§ 32.1-123 et seq.) of Title 32.1 or by the Department of Behavioral Health and Developmental Services pursuant to Article 2 (§ 37.2-403 et seq.) of Chapter 4 of Title 37.2 or (ii) a state agency or institution.
B"Crisis "Childreceiving orcenter" adolescent" means anya personcommunity-based underfacility licensed by the ageDepartment of 19Behavioral years.Health and Developmental Services to provide short-term assessment, observation, and crisis stabilization services.
4"Inpatient Healthtreatment" andmeans Developmentalmental Serviceshealth toor providesubstance short-termabuse assessment,services observation,delivered andon crisisa BehEvioral24-hour stabilizationper services.day basis in a hospital, alcohol or drug rehabilitation facility, an intermediate care facility or an inpatient unit of a mental health treatment center.
R "Inpatient treatment" means mental health or substance abuse services delivered on a 24-hour per day basis in a hospital, alcohol or drug rehabilitation facility, an intermediate care facility or an inpatient unit of a mental health treatment center.
"Medication management visit" means a visit no more than 20 minutes in length with a licensed physician or other licensed health care provider with prescriptive authority for the sole purpose of monitoring and adjusting medications prescribed for mental health or substance abuse treatment.
"Mental health treatment center" means a treatment facility organized to provide care and treatment for mental illness through multiple modalities or techniques pursuant to a written plan approved and monitored by a physician, clinical psychologist, or a psychologist licensed to practice in this Commonwealth.
"Network adequacy" means access to services by measure of distance, time, and average length of ref"Outpatientreferral treatment" means mental health or substance abuse treatment services rendered to ascheduled personvisit. as an individual or part of a group while not confined as an inpatient.
"Outpatient treatment" means mental health or substance abuse treatment services rendered to a person as an individual or part of a group while not confined as an inpatient.
Such a program shall provide treatment over a period of six or more continuous hours per day to individuals or groups of individuals who are not admitted as inpatients.
Such term shall also include intensive outpatientofoutpatient programs for the treatment of alcohol or other drug dependence which provide treatment over a period of 6 of three or more continuous hours per day to individuals or groups of individuals who are not admitted as inpatients.
of 6 "Residential crisis stabilization unit" means a community-based, short-term residential program providing licensed by the Department of Behavioral Health and Developmental Services to provide short-term assessment, observation, support, and crisis stabilization for individuals who are experiencing an acute mental health crisis.
For the purpose of this section, medication management visits shall be covered in the same manner as a medication management visit for the treatment of physical illness and shall not be counted of 6 as an outpatient treatment visit in the calculation of the benefit set forth herein.
For the purpose of this subsection, if all covered expenses for a visit for outpatient meEtalmental health or substance abuse treatment apply toward any deductible required by a policy or contract, such visit shall not count toward the outpatient visit benefit maximum set forth in the policy or contract.
This subsection shall not apply to any excepted benefits policy as defined in § 38.2-3431R38.2-3431, nor to of 6 policies or contracts designed for issuance to persons eligible for coverage under Title XVIII of the governmentalSocial plans.,Security Act, known as Medicare, or any other similar coverage under state or federal Ogovernmental E.plans.

The provisions of this section shall not apply in any instance in which the provisions ofEthisof this section are inconsistent or in conflict with a provision of Article 6 (§ 38.2-3438 et seq.) of Chapter 34.
The Bureau of Insurance, in consultation with health carriers providing coverage for mental health and substance use disorder benefits pursuant to this section, shall develop reporting requirements regarding denied claims, complaints, appeals, and network adequacy involving such coverage set forth in yearthis intosection. a report that ensures the confidentiality of individuals whose information has been reported and is written in nontechnical, readily understandable language.
By November 1 of each year, the Bureau shall compile the information for the preceding year into a report that ensures the confidentiality of individuals whose information has been reported and is written in nontechnical, readily understandable language.
This summary shall include the Bureau's S explanation of whether the analyses were accepted as compliant, rejected as noncompliant, or ar5are in process of review.
For analyses that were noncompliant, the report shall include the corrective3actionscorrective actions that the Bureau required the health carrier to take to come into compliance.
The Bureau shall mRkemake the report available to the public by, among such other means as the Bureau finds appropriate, posting the reports on the Bureau's website and submit the report to the House Committee on Commerce and Energy and the Senate Committee on Commerce and Labor.
§ 38.2-3438.
Definitions.
"Behavioral health crisis service provider" means a provider licensed by the Department of Behavioral Health and Developmental Services to provide mental health or substance useabuse services as a pro"Child"provider meansof amobile son,crisis daughter,response, stepchild,residential adoptedcrisis child,stabilization, includingor a childcrisis placedreceiving forcenter. adoption, foster child, or any other child eligible for coverage under the health benefit plan.
"Child" means a son, daughter, stepchild, adopted child, including a child placed for adoption, foster child, or any other child eligible for coverage under the health benefit plan.
"Emergency medical condition" means, regardless of the final diagnosis rendered to a covered person, a medical condition manifesting itself by acute symptoms of sufficient severity, including severe pain, so that a prudent layperson, who possesses an average knowledge of health and medicine, could reasonably expect the absence of immediate medical attention to result in (i) serious jeopardy to the mental or physical health of the individual, (ii) danger of serious impairment to bodily functions, (iii) serious dysfunction of any bodily organ or part, or (iv) in the case of a pregnant woman, serious jeopardy to the health of the fetus.

"Essential health benefits" include the following general categories and the items and services of 6 covered within the categories in accordance with regulations issued pursuant to the PPACA as of January 1, 2019:
evidence of insurability, including conditions arising out of acts of domestic of 6 violence;
"Individual health insurance coverage" means health insurance coverage offered to individualEindividuals in the individual market, which includes a health benefit plan provided to individuals through a trust arrangement, association, or other discretionary group that is not an employer plan, but does not include coverage defined as "excepted benefits" in § 38.2-3431 or short-term limited duration insuranceRinsurance. Student health insurance coverage shall be considered a type of individual health insurance coverage.

"Managed care plan" means a health benefit plan that either requires a covered person to use, or creates incentives, including financial incentives, for a covered person to use health care providers managed, owned, under contract with, or employed by the health carrier.
"Nonprofit data services organization" means the nonprofit organization with which the Commissioner of Health negotiates and enters into contracts or agreements for the compilation, storage, analysis, and evaluation of data submitted by data suppliers pursuant to § 32.1-276.4.
"Offer to pay" or "payment notification" means a claim that has been adjudicated and paid by a carrier or determined by a carrier to be payable by an enrollee to an out-of-network provider fSrfor services described in subsection A of § 38.2-3445.01.
5 "Open enrollment" means, with respect to individual health insurance coverage, the period of3timeof time during which any individual has the opportunity to apply for coverage under a health benefit plRnplan offered by a health carrier and must be accepted for coverage under the plan without regard to a preexisting condition exclusion.
"Out-of-network" or "nonparticipating" means a provider that has not contracted with a carrier or a car"Out-of-pocketcarrier's maximum"contractor or "maximumsubcontractor out-of-pocket"to meansprovide thehealth maximumcare amountservices an enrollee is required to payenrollees. in the form of cost-sharing requirements for covered benefits in a plan year, after which the carrier covers the entirety of the allowed amount of covered benefits under the contract of coverage.

of 6 "Stabilize" means with respect to an emergency medical condition, to provide such medical treatment as may be necessary to assure, within reasonable medical probability, that no material deterioration of the condition is likely to result from or occur during the transfer of the individual from a facility, or, with respect to a pregnant woman, that the woman has delivered, including the placenta.
