E N [S 1452] Approved AprilR 12, 2023 Be it enacted by the General Assembly of Virginia:
O 1.
Notwithstanding Article 1.1 (§ 32.1-102.1 et seq.) of Chapter 4 of Title 32 of the CodeCodeLof of Virginia and any applicable regulations, the State Health Commissioner shall accept and review applications and shall issue a certificate of public need for a new 90-bed nursing home facility, given the unique and extenuating circumstances of this potential facility, provided that such facility is located on the property of the former Central Virginia Training Center in Amherst County and is owned by thethelocated Commonwealth as of July 1, 2023.
Such beds may be transferred by the Commonwealth upon sale of 2.D the property.
That2. when Central Virginia Training Center (CVTC) property is declared surplus to the needs of the Commonwealth and offered for sale by the Department of General Services (the Department), the Department shall include in any CVTC property sale request for offer (RFO) information on the availability of funding, if any, for costs associated with the demolition or renovation of existing structures on such property.

The Department shall require from the successful offeror a performanceperformanceR bond to complete the demolition and renovation of the structures identified in its proposed development plan.
In addition, the Department's RFO will address any certificate of public needneed2 authority approved by the Department of Health that may be available to a developer for the purposes of providing a 90-bed nursing home facility on such property.
If the Department does not receive an offer to develop such property that includes complete demolition and renovation of suchbe identifiedsold.ntified structures and obtain the required performance bond, then such property shall not be sold.
