The recent amendment to SB 1491 clarifies that local public bodies can enter into construction contracts using a fixed price or not-to-exceed price, while emphasizing the importance of adhering to established procedures. It also specifies that a licensed architect or engineer must be engaged prior to deciding on construction management or design-build methods, ensuring professional oversight in the project. These changes matter because they aim to enhance accountability and ensure that local governments make informed decisions regarding construction projects, which can ultimately lead to better project outcomes and use of taxpayer funds.
