The amendment to § 65.2-709 of the Code of Virginia clarifies the conditions under which cost of living supplements are payable for total incapacity and for dependents of deceased individuals. Specifically, it removes a clause about the claimant receiving disability payments under the state program without corresponding federal benefits and focuses solely on the combined benefit amount being less than 80% of the claimant's average monthly earnings before disability or death. This change matters because it may refine the eligibility criteria for supplements, ensuring they are provided based on a clear comparison of benefits received.
