The amended bill SB 52 clarifies that a locality can require developers to pay their fair share of the costs for necessary sewer, water, and drainage facilities, even if those facilities are located outside their property boundaries. Previously, developers were only obligated to pay once a general improvement program was established, but the amendment emphasizes that they can be held responsible as soon as the need arises due to their construction projects. This change matters because it helps ensure that new developments contribute to local infrastructure improvements that support water quality and manage runoff, ultimately benefiting the entire community.
