RMH S01375'25 (S-2)(S-3)_SB599_APS_1 debxu3ory2fc 1 (h) "Industrial hemp" means that term as defined in section 3 of the Michigan Regulation and Taxation of Marihuana Act, 2018 IL 1, MCL 333.27953.
(q) "THC" means that term as defined in section 3 of the RMH S01375'25 (S-2)(S-3)_SB599_APS_1 debxu3ory2fc 1 Michigan Regulation and Taxation of Marihuana Act, 2018 IL 1, MCL 333.27953.
RMH S01375'25 (S-2)(S-3)_SB599_APS_1 debxu3ory2fc 1 Sec.
RMH S01375'25 (S-2)(S-3)_SB599_APS_1 debxu3ory2fc 1 (c) The applicant's buildings or locations disclosed on an application submitted under this chapter are dwellings or are not located in this state.
(1) To modify a site location listed in an application submitted under this chapter, the licensee shall do RMH S01375'25 (S-2)(S-3)_SB599_APS_1 debxu3ory2fc 1 both of the following:
(3) A consumable hemp processor shall not purchase a converted RMH S01375'25 (S-2)(S-3)_SB599_APS_1 debxu3ory2fc 1 cannabinoid for use in processing a consumable hemp product.
(a) Process, sell, or otherwise transfer a product that contains greater than 1.75 milligrams per container of an intoxicating or potentially intoxicating cannabinoid.
RMH S01375'25 (S-3)_SB599_APS_1 ory2fc 1 (a) Contain the following statements in bold capital letters:
RMH S01375'25 (S-2) debxu3 1 (i) "THIS PRODUCT HAS NOT BEEN EVALUATED BY THE FOOD AND DRUG ADMINISTRATION AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE.".
(a) Full spectrum industrial hemp extractextract. that contains no more than 1.75 milligrams of THC per serving and contains a ratio of cannabidiol to THC of greater than or equal to 15-1.
(b) Broad spectrum industrial hemp extract.
(c) Cannabidiol.
(d) Tetrahydrocannabivarin.
(e) Cannabichromene.
(f) Cannabicitran.
(g) Cannabicyclol.
(h) Cannabielsotin.
(i) Cannabigerol.
(j) Cannabidivarin.
(k) Cannabinol.
(l) Any other cannabinoid that the agency determines in rules promulgated under this act is nonintoxicating.
(c) Metabolites of THC, including 11-hydroxy-THC, 3-hydroxy- RMH S01375'25 (S-2) debxu3 1 THC, or 7-hydroxy-THC.
RMH S01375'25 (S-3)_SB599_APS_1 ory2fc 1 (i) Any combination of the compounds, including hexahydrocannabiphorol-O-ester, listed above.
The rules must include, RMH S01375'25 (S-2) debxu3 1 but are not limited to, the following:
(ii) A regulatory testing facility that complies with the industrial hemp growers act, 2020 PA 220, MCL 333.29101 to RMH S01375'25 (S-3)_SB599_APS_1 ory2fc 1 333.29801.
(2) The agency may promulgate an emergency rule in accordance with section 48 of the administrative procedures act of 1969, 1969 PA 306, MCL 24.248, if the agency determines that a cannabinoid is an intoxicating cannabinoid or potentially intoxicating cannabinoid and that consumption of the cannabinoid poses a risk to public RMH S01375'25 (S-2) debxu3 1 health and safety.
RMH S01375'25 (S-3)_SB599_APS_1 ory2fc 1 (3) Fees collected under subsection (2) must be deposited into the fund.

RMH S01375'25 (S-3)_SB599_APS_1 ory2fc 1 (2) If the agency suspends, revokes, or restricts a state license under this section, the agency shall notify the licensee in writing that the state license is suspended, revoked, or restricted.
(4) Except as otherwise provided inunder thissection subsection,505, the agency may impose a civilperson finethat ofviolates not more than $5,000.00 against an individual and not more than $10,000.00 against a licensee, for a violation of this act or a rule promulgated under this act.act is subject to the following:
Assessment(a) ofFor a civillicensee, fine under this subsection is not a barcivil tofine the investigation, arrest, charging, or prosecution of an individual or licensee for any other violation of this act or a rule promulgated under this act and is not groundsmore tothan suppress$10,000.00. RMH S01375'25 (S-2) debxu3 1 evidence in any criminal prosecution that arises under this act or any other law of this state.
(b) For a person that is not a licensee, a civil fine of not more than $5,000.00.
(5) Assessment of a civil fine under subsection (4) is not a bar to the investigation, arrest, charging, or prosecution of a licensee or individual for any other violation of this act or a rule promulgated under this act and is not grounds to suppress evidence in any criminal prosecution that arises under this act or any other law of this state.
RMH S01375'25 (S-3)_SB599_APS_1 ory2fc 1 (3) The agency may suspend a state license without notice or hearing on a determination that the public health, safety, or welfare is jeopardized by allowing the licensee to continue to obtain, process, package, transport, or distribute a consumable hemp product.
The agency's authorized RMH S01375'25 (S-2) debxu3 1 representative may issue subpoenas and administer oaths and affirmations to witnesses.
(1) A person that violates section 301(4)201(1) is guilty asof follows:a misdemeanor punishable by a fine of not less than $10,000.00 or more than $25,000.00 or imprisonment for not more than 93 days, or both.
(a)(2) ForA aperson firstthat violation,violates asection misdemeanor301(4) punishableis byguilty aas finefollows: of not less than $10,000.00 or more than $25,000.00 or imprisonment for not more than 93 days, or both.
(b)(a) ForExcept aas secondotherwise orprovided subsequentunder violation,subdivision a(b): misdemeanor punishable by a fine of not less than $10,000.00 or more than $25,000.00 or imprisonment for not more than 1 year, or both.
