[NEW MATERIAL] DEFINITIONS.--As used in the Geologic Carbon Dioxide Storage Stewardship Act:
"carbon dioxide" means carbon dioxide produced by anthropogenic sources or captured from the atmosphere, including qualified carbon oxide as defined pursuant to applicable federal law and carbon dioxide stream as may be defined in federal law and regulations pertaining to class HENRCº6 VI»HENRC HENRCº6»HENRC carbon dioxide injection wells;
"geologic sequestration" means the long- or short-term underground sequestration of carbon dioxide within a geologic stratum, formation, aquifer, cavity or void, whether naturally or artificially created, including deep saline aquifers, oil and gas reservoirs and unminable coal seams, such that injected carbon dioxide does not escape to HB 458/a Page 1 the atmosphere;

"operator" means a person who has the right to g o t hr inject carbon dioxide for geologic sequestration into a g e i k sequestration facility, whether for the person's own account or h r i s for the account of others;

"pore space" means the empty space between e u g e b l e e h rock grains, fractures and voids in the earth's subsurface;

The Geologic Carbon Dioxide Storage Stewardship Act applies to sequestration facilities that commence injection of carbon dioxide after the effective date of that act;
The fees collected from operators and deposited in the geologic carbon dioxide long-term storage stewardship h fund shall not relieve a facility owner or operator from uHB »458/a rPage 3 responsibility for posting and maintaining financial assurance t h g e l i mechanisms as required by applicable statutes and rules or from h r i s any liability caused by conditions or operation of a h , e h sequestration facility prior to transfer of stewardship.

An operator that has obtained a permit for e r = t e w d m a n o geologic carbon dioxide sequestration may ask for a certificate dof mclosure :for that site;

The commissioner of public lands or a state agency may grant to an operator a certificate of closure for geologic sequestration on lands subject to the agency's h jurisdiction on such terms as the agency finds are HB 458/a Page 4 reasonable.

The fund consists of fees collected from operators at a rate of HAFCº not less than»HAFCthan ten cents ($.10) per metric ton of carbon dioxide injected for storage pursuant to applicable statutes and rules, distributions, appropriations, gifts, grants and donations.
HAFCº The oil conservation commission shall establish by rule a fee schedule sufficient to meet the projected needs of the fund.»HAFC All fees collected pursuant to this section shall be transmitted to the state treasurer for credit to the fund.

(7) compliance and enforcement activities related to geologic sequestration facility operation and associated class HENRCº6 VI»HENRC HENRCº6»HENRC injection wells;
(8) oversight and management of geologic h sequestration facilities and associated class HENRCº6 VI»HENRC g o t hr HENRCº6»HENRC injection wells after site closure;
and gHB e458/a iPage k6 (9) emergency response as deemed necessary by h r i s the director of the division.

[NEW MATERIAL ] CERTIFICATE OF COMPLETION OF e b l e e h INJECTION OPERATIONS--LIABILITY RELEASE.-- n d d i = = o h A.
The division shall issue a certificate of l ] b ,d i a º e r i = r completion of injection operations upon a showing by the t e w d m a n o operator of a sequestration facility and a division finding dthat mthe :requirements of Subsection E of this section have been satisfied.

(1) all stewardship HAFCº and»HAFC HENRCºlegal»HENRC responsibilities for the sequestration facility HENRCºthatthat are covered in Subsection B of Section 5 of the Geologic Carbon Dioxide Storage Stewardship Act»HENRCAct, , including the stored carbon dioxide, shall transfer to the state;
(2) the operator, owners and all persons who generated, transported or injected carbon dioxide into the sequestration unit and all owners otherwise having an interest in the sequestration unit and sequestration facility or the injected carbon dioxide shall be released from all stewardship responsibilities associated with or related to the h sequestration unit and sequestration facility;
u » r (3) all bonds posted by or on behalf of the t h g e l i operator shall be released;
and hHB r458/a iPage s7 (4) the state shall succeed and be subject to h , e h the terms of all agreements, permits, rules, regulations and t u g e b l e e , gh orders applicable to the owner or operator and its successors, n d d i = = o h and the sequestration facility and all monitoring, repair and l ] b ,d i a º r remediation required by law shall become the state's eresponsibility rto =be toverseen eby wthe ddivision, munless aand nuntil othe responsibilityfederal togovernment beassumes overseenresponsibility byfor the division,long-term unlessmonitoring and untilmanagement dof mthe :sequestration unit and sequestration facility.

h (3) the operator violated a state statute or u » r rule related to the sequestration facility that was not t h g e l i remedied prior to approval of site closure and any applicable hHB r458/a iPage s8 statutes of limitation have not run;
h , e h (4) liability arises from the operator's t u g e b l e e , gh conduct associated with the sequestration facility or n d d i = = o h sequestration unit that, if known, would have materially l ] b ,d i a º r affected the division's decision in issuing the certification e r = t e w d m a n o of completion;
d(5) mthe :division determines that there is fluid migration for which the owner or operator is responsible that causes or threatens imminent and substantial endangerment to an underground source of drinking water;

The division shall set the certification matter for hearing and, in addition to notice otherwise required by law or the division's rules, shall cause the operator to give notice of the hearing, specifying the time and place of the hearing and describing briefly the hearing's purpose and the land and formations affected, to be mailed by certified mail at least thirty days prior to the hearing to all persons whose names and addresses are required to be listed in the h application.

The certificate of completion of injection t h g e l i operations shall be issued upon a showing by the operator and hHB r458/a iPage s9 division findings that:
h , e h (1) the operator is in full compliance with t u g e b l e e , gh all laws governing the sequestration unit and sequestration n d d i = = o h facility;
l ] b ,d i a º r (2) the operator has resolved all claims, e r = t e w d m a n o pending or perfected, regarding the sequestration unit and dsequestration mfacility; :

[NEW MATERIAL] OWNERSHIP OF PORE SPACE WITHIN THE EARTH.-- h A.
Absent specific language in a severing g o t hr instrument to the contrary, the surface estate includes the g e i k pore space, and the ownership of all pore space in all strata hHB r458/a iPage s10 below the surface lands and waters of this state is declared to h , t, e u g be vested in the several owners of the surface above the strata e b l e e h or formations.

To the extent the dominant mineral estate is l ] b ,d i a º e r i = r reasonably utilizing the surface estate for the production of t e w d m a n o minerals located thereon and therein, the formations so used dshall mnot :be interfered with.
