Hazing consists of any actintentional, committedknowing asor partreckless ofact acommitted person'sby recruitment, initiation, pledging, admission into or affiliation with a studentperson, organization,whether athleticindividually team or living group or any pastime or amusement engaged in concert with respect to such an organization, athletic team or living group that causes, or is likely to cause, bodily danger or physical harm or serious psychological or emotional harm to a student or e t 17 other personpersons, attendingagainst a publicstudent, or private school or a w l n d 18 public or private post-secondary educational institution, = = 19 a l including causing, directing, coercing or forcing a person to i a e r 20 consume any food, liquid, alcohol, drug or other substance that a t m m 21 subjects the person to risk of such harm, regardless of thethat dstudent's r e 22 person's willingness to participate.participate, that:

If the student organization, association or student living group is a corporation, whether for-profit or nonprofit, the individual directors of the corporation may be held individually liable e t 17 for damages.

A person who participates in the hazing of = = 19 a l another shall forfeit any entitlement to state-funded grants, i a e r 20 scholarships or awards for a period of time determined by the a t m m 21 public or private schoolpost-secondary or the public or private post- d r e 22 secondary educational institution.

Any organization, association or student living e at n17 b 24 group that knowingly permits hazing to be conducted by its uw [l n d 18 members or by others subject to its direction or control shall .229562.3= -= 319 - forfeit any official recognition or approval granted by the a publicl ori privatea schoole orr a20 public or private post-secondary educational institution.

Failure to report hazing consists of an d r e 22 administrator, a faculty member, a coach, an employee, an c e s k 23 independent contractor performing or overseeing school e a n b 24 functions or a volunteer of a student organization of a public oru private[ school or a public or private post-secondary educational institution who knows or .230145.2 - 3 - SEC/SB 10 reasonably should know of hazing conduct or activity described in the Anti-Hazing Act and fails to report the incident to a law enforcement agency.

[NEW MATERIAL] REQUIREMENT FOR CODE OF CONDUCT w l n d 18 AT A PUBLIC OR PRIVATE POST-SECONDARY EDUCATIONAL INSTITUTION-- = = 19 a l HAZING PREVENTION COMMITTEE.-- i a e r 20 A.
A public or private post-secondary educational a t m m 21 institution shall prohibit in its code of conduct hazing off- d r e 22 and on-campus.

Beginning with the 2025 fall academic term, a e a n b 24 public or private post-secondary educational institution shall ue [t 17 provide students with an educational program on hazing and the .229562.3w -l 4n -d 18 dangers of and prohibition on hazing that shall include = = 19 information regarding hazing awareness, prevention, a l i a e r 20 intervention and the institution's policy on hazing.
The a t m m 21 educational program may be offered in person or electronically.
d r e 22 The institution shall incorporate the educational program as c e s k 23 part of new student orientation sessions.
The educational e a n b 24 program shall be posted on the institution's public website for u [ parents, legal guardians and volunteers to view.

The committee shall e t 17 have a minimum of six members, including a designated chair w l n d 18 appointed by the president of the institution.
Fifty percent = = 19 a l of the committee members shall include students currently i a e r 20 attending the public or private post-secondary educational a t m m 21 institution, and at least one position shall be filled by a d r e 22 student from a student organization, athletic team or living c e s k 23 group.
The other fifty percent of the committee members shall e a n b 24 include at least one faculty or staff member and one parent or ue [t 17 legal guardian of a student currently enrolled at the .229562.3w -l 5n -d 18 institution.
Student input shall be considered for committee = = 19 membership.
A student who is a member of a student a l i a e r 20 organization, athletic team or living group that was affiliated a t m m 21 with a finding of a hazing violation within the last twelve d r e 22 months may not participate in or be a member of the hazing c e s k 23 prevention committee.

A public or private post-secondary educational institution shall make reports maintained pursuant to this e t 17 section available on the institution's website in a prominent w l n d 18 location that is clearly labeled and easily accessible.

Beginning in the 2025 fall academic term, a d r e 22 public or private post-secondary educational institution shall c e s k 23 provide hazing prevention education on the signs and dangers of e a n b 24 hazing as well as the institution's prohibition on hazing to u [ employees, including student employees, either in person or .230145.2 - 7 - SEC/SB 10 electronically.
If, as a result of observations or information received in the course of employment or volunteer service, any employee, including a student employee or volunteer at a public or private post-secondary educational institution, has reasonable cause to believe that hazing has occurred, the employee or volunteer shall report the incident, or cause a report to be made, to a designated authority at the e t 17 institution.
The employee or volunteer shall make the report w l n d 18 at the first opportunity to do so.

A person who witnesses hazing or has reasonable i a e r 20 cause to believe hazing has occurred or will occur and makes a a t m m 21 report in good faith may not be sanctioned or punished for the d r e 22 violation of hazing unless the person is directly engaged in c e st k17 23 the planning, directing or act of hazing reported.

Nothing in this section shall preclude a person u= [= 19 from independently reporting hazing or suspected hazing .229562.3a -l 8i -a e r 20 activity to law enforcement.
a t m m 21 SECTION 7.
[NEW MATERIAL] REQUIREMENTS FOR SOCIAL d r e 22 FRATERNITY AND SORORITY ORGANIZATIONS.-- c e s k 23 A.
Social fraternity and sorority organizations e a n b 24 shall notify a public or private post-secondary educational u [ institution before chartering, rechartering, opening or .230145.2 - 8 - SEC/SB 10 reopening a local chapter or operating at the public or private post-secondary educational institution.
The organization shall provide the results of such an investigation and a copy of the full findings report to the e t 17 public or private post-secondary educational institution's w l n d 18 student conduct office.

Beginning in the 2025 fall academic term, a i a e r 20 local social fraternity or sorority chapter seeking to obtain a t m m 21 or maintain registration with a public or private post- d r e 22 secondary educational institution in the state shall certify in c e st k17 23 writing and provide web links to the institution showing that ew al n bd 2418 the landing pages of all websites owned or maintained by the u= [= 19 local chapter contain a full list for the previous five years .229562.3a -l 9i -a e r 20 of all findings of violations of anti-hazing policies, state or a t m m 21 federal laws relating to hazing, alcohol, drugs, sexual assault d r e 22 or physical assault or the institution's code of conduct c e s k 23 against the local chapter.

Failure of a social fraternity or sorority u [ organization to comply with this section shall result in .230145.2 - 9 - SEC/SB 10 automatic loss of recognition until such time that the organization comes into compliance with this section.
