An employer granted a waiver pursuant to Subsection G of this section and the employer's employees shall have the same rights and protections enjoyed by employers and employees covered pursuant to the Welcome Child and Family Wellness Leave Act, including the right to appeal a waiver granted or denied by Subsection G of this section to the department.

and (3) the maximum amount of weekly family wellness leave payments shall be no more than the annual mean wage of all occupations in New Mexico as calculated by the United States bureau of labor statistics state occupational employment and wage estimates for the most recent year available divided by fifty-two.
