SECTION 1.
The "tribal education trust fund" is created as a t m m 21 a nonreverting fund in the state treasury.
[NEW MATERIAL ] TRIBAL EDUCATION TRUST FUND--CREATED--PURPOSE--DISTRIBUTION--REPORTING REQUIREMENTS-- PUBLIC EDUCATION DEPARTMENT DUTIES--APPROPRIATION.-- A.
The tribal d r e 22 education trust fund shall be used for any purpose enumerated c e s k 23 in Section 22-23A-2 NMSA 1978 or in an intergovernmental e a n b 24 agreement between an Indian nation, tribe or pueblo and the u [ public education department.
The "tribal education trust fund" is created as a nonreverting fund in the state treasury.
The fund consists of .226731.3 distributions, appropriations, gifts, grants and donations.

The public education department shall create a disbursement formula, in consultation with the tribal education trust fund disbursement formula task force created pursuant to Section 2 of this 2024 act, that ensures that a New Mexico tribe receives nonreverting disbursements each year on July 15 that the New Mexico tribe may use to carry out the purposes of the Indian Education Act.

This summary shall include a brief narrative describing how the budget and plan will contribute to meeting»Hfl1 Hfl1ºthe tribe's annual plan for using the funds in accordance with»Hfl1 the purposes of the Indian Education Act Hfl1ºand shall include with that plan the tribe's annual spending report and the tribe's assessment of impact and outcomes using tribally determined criteria»Hfl1 .

A consensus proposal for task force membership developed by the representatives of the twenty-three Indian nations, tribes and pueblos shall be presented to the legislative education study committee no later than September 1, 2024.
The task force shall report its recommendations c e s k 23 for a disbursement formula to the governor, the legislature and e a n b 24 the secretary of public education prior to July 1, 2025.

The task force shall reconvene on July 1, 2030 .226731.3 - 7 - to review and assess the equity and functionality of the disbursement formula and provide additional recommendations, if necessary, to the governor, the legislature and the secretary of public education prior to July 1, 2031.

Members of the task force may receive per diem and mileage as provided for nonsalaried public officers in the Per Diem and Mileage Act and shall receive no other compensation, perquisite or allowance.

The task force shall ensure that the disbursement formula is equitable for each Indian nation, tribe and pueblo located wholly or in part in the state.
SECTION 4.
The task force shall consider tribal needs and tribal size, including both a base and student count elements for the disbursement formula.
EFFECTIVE DATE.--The effective date of the e t 17 provisions of this act is July 1, 2024.

APPROPRIATION.--One hundred million dollars ($100,000,000) is appropriated from the general fund to the tribal education trust fund for expenditure in fiscal year and subsequent fiscal years to carry out the purpose of the tribal education trust fund.
