or (6) there is any amount of a drug, substance, or compound in the person's breath, blood, or urine resulting from the unlawful use or consumption of cannabis listed in the Cannabis Control Act, a controlled substance listed in the Illinois Controlled Substances -2- LRB093 08341 DRH 08560 b Act, or an intoxicating compound listed in the Use of Intoxicating Compounds Act.
or (6) there is any amount of a drug, substance, or compound in the person's breath, blood, or urine resulting from the unlawful use or consumption of cannabis listed in the Cannabis Control Act, a controlled substance listed in the Illinois Controlled Substances HB1358 Engrossed -2- LRB093 08341 DRH 08560 b Act, or an intoxicating compound listed in the Use of Intoxicating Compounds Act.
The imprisonment or assignment under this subsection shall not be -3- LRB093 08341 DRH 08560 b subject to suspension nor shall the person be eligible for probation in order to reduce the sentence or assignment.

or (E) the person, in committing a violation of paragraph (a) while driving at any speed in a school speed zone at a time when a speed limit of 20 miles per hour was in effect under subsection (a) of Section 11-605 of this Code, was involved in a motor vehicle accident that resulted in bodily harm, other HB1358 Engrossed -6- LRB093 08341 DRH 08560 b than great bodily harm or permanent disability or disfigurement, to another person, when the violation of paragraph (a) was a proximate cause of the bodily harm.
(e) After a finding of guilt and prior to any final sentencing, or an order for supervision, for an offense based upon an arrest for a violation of this Section or a similar provision of a local ordinance, individuals shall be required to undergo a professional evaluation to determine if an alcohol, drug, or intoxicating compound abuse problem exists and the extent of the problem;_________________r_____________ _____n_______________________t____________________h_____________ _____m_____________________l______________________c_____________ _____d______________________a_____________________m_____________ _____c______________________o_____________________t_____________ _____d_____________________o______________________i_____________ ______b____________________e______________________r_____________ ______o____________________o______________________t_____________ _____m_____________________i________________________s___________ _______g___________________s______________________h_____________ _____m____________---------e-----------------------t------------ -----p---------------------u----------------------n------------- -----s---------------------e------------------------T----------- -----p---------------------i----------------------f------------- -7- LRB093 08341 DRH 08560 b -----i---------------------e----------------------e----------.

If the person has been previously convicted of violating this Section or a similar provision of a local ordinance, the fine -8- LRB093 08341 DRH 08560 b shall be $200.
If the person has been previously convicted of violating this HB1358 Engrossed -8- LRB093 08341 DRH 08560 b Section or a similar provision of a local ordinance, the fine shall be $200.
