AMENDING SECTION 18-2509,18-2508, IDAHO CODE, TO CLARIFYREVISE A CODEPROVISION REFERENCEREGARDING THE ESCAPE OR HARBORING OF CERTAIN PERSONS AND TO MAKEPROVIDE A TECHNICALPENALTY; CORRECTION.

AND REPEALING SECTION 18-2509, IDAHO CODE, RELATING TO PUNISHMENT FOR A VIOLATION OF THE PRECEDING SECTION.

That Section 18-2509,18-2508, Idaho Code, be, and the same is hereby amended to read as follows:

18-2509.18-2508.

PUNISHMENTINMATES FOROF VIOLATIONPERSONS OFCOMMITTED PRECEDINGTO SECTION.PUBLIC INSTITUTIONS -- EN- TICING, AIDING TO ESCAPE, OR HARBORING OR EMPLOYING UNLAWFUL.

Any(1) personIt violatingshall be unlawful for any person, firm, copartnership, corporation or association to knowingly entice, the provisionsescape of thisor actharbor, sectionemploy, 18-2508,or Idahoaid, Code,assist uponor con-abet viction,in shallthe beescape, punishedenticing, byharboring aor fineemployment of notany lessdelinquent, thaninsane, twenty-fivefeeble-minded dollarsor ($25.00)incorrigible norperson morecommitted thanto, oneor thousandconfined dollarsin ($1,000),any orin- imprisonmentstitution inmaintained by the countystate jail for notthe lesstreatment, thaneducation thirtyor (30)welfare daysof nordelinquent moreor thanfeeble-minded, ninetyincorrigible (90)or days,insane persons committed to or both.confined therein .

(2) Any person who violates the provisions of subsection (1) of this section shall be guilty of a misdemeanor and on conviction shall be punished by a fine not exceeding one thousand dollars ($1,000) or imprisonment in the county jail for a period not exceeding one (1) year, or both.

SECTION 2.

That Section 18-2509 , Idaho Code, be, and the same is hereby repealed.
