A health-related research facility must submit an annual report to the department of public health and environment that includes the following information for the previous year:
! The total number of dogs and cats that are used for health-related research conducted at the health-related research facility;
! The total number of dogs and cats that the health-related research facility transferred to an animal shelter or a pet animal rescue for the purpose of adoption;
! The total number of dogs and cats that the health-related research facility adopted out through an internal adoption program;
and ! The name and address of each animal shelter or pet animal rescue to which the health-related research facility transferred a dog or cat for the purpose of adoption.

(1) (a) BEFORE EUTHANIZING A DOG OR CAT , A HEALTH -RELATED RESEARCH FACILITY SHALL OFFER THE DOG OR CAT TO AN ANIMAL SHELTER OR A PET ANIMAL RESCUE FOR THE PURPOSE OF -3- 085 ADOPTION .
F THE HEALTH RELATED RESEARCH FACILITY HAS AN INTERNALADOPTION PROGRAM ,THE FACILITY MAY FIRST OFFER THE DOG OR CAT FOR ADOPTION THROUGH THE INTERNAL ADOPTION PROGRAM BEFORE OFFERING THE DOG OR CAT TO AN ANIMAL SHELTER OR A PET ANIMAL RESCUE .
(b) SUBSECTION (1)(a)OF THIS SECTION DOES NOT APPLY IF A HEALTH -RELATED RESEARCH FACILITY EUTHANIZES A DOG OR CAT FOR RESEARCH ,HEALTH,OR SAFETY REASONS .
(2) A HEALTH-RELATED RESEARCH FACILITY MAY ENTER INTO A COLLABORATIVEAGREEMENTWITHANANIMALSHELTERORAPETANIMAL RESCUE TO SATISFY THE REQUIREMENTS OF THIS SECTI.N (3) AHEALTH -RELATED RESEARCH FACILITY THAT ACTS IN GOOD FAITH TO TRANSFER OR ADOPT OUT THROUGH AN INTERNAL ADOPTION PROGRAM A DOG OR CAT TO AN ANIMAL SHELTER OR A PET ANIMAL RESCUE PURSUANT TO SUBSECTION(1)OF THIS SECTION IS IMMUNE FROM CIVILLIABILITYFORACTSORCIRCUMSTANCESRELATEDTOORRESULTING FROM THE TRANSFER OR INTERNAL ADOPTION OF THE DOG OR CA.
(4) (a) B JANUARY 31, 2026,AND BYJANUARY 31EACH YEAR THEREAFTER ,A HEALTH-RELATED RESEARCH FACILITY SHALLSUBMIT TO THEDEPARTMENT ,ONAFORMAPPROVEDBYTHEDEPARTMENT ,AREPORT THAT INCLUDES THE FOLLOWING INFORMATION FOR THE PREVIOUS CALENDAR YEAR :
(I) THE TOTAL NUMBER OF DOGS AND CATS THAT THE HEALTH -RELATED RESEARCH FACILIT:
(A) T RANSFERRED TO AN ANIMAL SHELTER OR A PET ANIMAL RESCUE FOR THE PURPOSE OF ADOPTIO;AND -4- 085 (B) A DOPTED OUT THROUGH AN INTERNAL ADOPTION PROGRAM ;
AND (II)THE NAME AND ADDRESS OF EACH ANIMAL SHELTER OR PET ANIMAL RESCUE TO WHICH THE HEALTH RELATED RESEARCH FACILITY TRANSFERRED A DOG OR CAT FOR THE PURPOSE OF ADOPTIO.
(b) A HEALTH-RELATED RESEARCH FACILITY WITH AN INTERNAL ADOPTION PROGRAM SHALL NOT REPORT ANY PERSONAL IDENTIFYING INFORMATION ABOUT AN INDIVIDUAL INTERNAL ADOPTER.
SECTION 2.
Act subject to petition - effective date.
This act takes effect at 12:01 a.m.
on the day following the expiration of the ninety-dayperiodafterfinaladjournmentofthegeneralassembly;except that, if a referendumpetition isfiledpursuant to section 1 (3) of article V of the state constitution against this act or an item, section, or part of this act within such period, then the act, item, section, or part will not take effect unless approved bythe people at the general election to be held in November 2026 and, in such case, will take effect on the date of the official declaration of the vote thereon by the governor.
